    And how much per week was she earning before she went sick? she might not have been eligible for any sick pay hence why they havnt paid her.

    Let's be utterly clear about this The OP does not want advice. The OP wants to be told that they are right. So here we go...

    She's still employed, it doesn't matter how long she has worked there, an ET don't require any evidence and they don't give a damn about deadlines. Happy now?



    She didn't bother to submit sick notes - it doesn't matter whether she was receiving sick pay or not. She is required to be in work or providing sick notes. The minute she decided not to bother submitting sick notes she was in breach of her contract and therefore she has terminated her contract herself. And that isn't my opinion - it's the law.

    Ok well I see your point ref the sick notes, but that is not the question, they say she is employed, so she is employed! Right???

    I do not think I am right, I just want to know how to get the money out of them!.

    SAREL - I respect your knowledge, but in my post I clearly stated that I know it is too late for ET, due to the discrimination being over 3 months old. Please do not make me out to be stupid, you are right with what you say hence why we are not at ET.

    There is no question on sick pay, she was not due any AT ALL from anyone. She did not work at the business for two years, I understand the limited rights due to this.

    Please do not judge me because I do not respond telling you how long she worked at the business for, I simply did not read your post and have now seen all of your post with Caps, red and just about everything else.

  • Sorry I just missed that bit and was reading quickly.

    I would also point out this is not me, hence I can not make a decision to send in sick notes if she does not want to. Yes I agree there has been some wrong, but I now need to save this situation in the best possible way.

  • Well in the eyes of the law no, she had "work related stress", some people define this as sick but most legal people say not :-/

    Get her to resign formally. The company should then forward her P45 and any monies she's due shortly afterwards.
