ASDA and Bank Holiday 2nd January 2012

  • To clarify, (although its perfectly clear), if a business is normally open at the weekend they are perfectly entitled to say that the day they will give any enhanced bank holiday payments will be the actual holiday rather than the day in lieu which in this case was today. However for a business not open at the weekend then it will be the day in lieu which would qualify.

    1. It was the first time the business opened on Sunday 1st January.
    2. Home shopping was shut on Sunday 1st January. Staff we told not to go in and had to put a holiday in if they wanted paying.
    3. Monday 2nd January was not a normal home shopping day, it was treated as a Sunday with half as much staff and twice as much work to do in half the number of allocated loads. Some staff who turned up to work a normal shift were told go home and put a holiday in for Monday or they wouldn't be paid.

    My issue is that it's all well and good them saying if the store is open on Sunday 1st then staff get paid time and a half, but they should either pay staff who's shift it is who dont work on that day or time and half for staff who work on the monday (who didn't on the sunday because their department was closed.) Asda is having their cake and eating it IMHO.

    Im on the other end of it, i worked sunday without any additional benefit to pay, however coleagues who worked monday (i did aswell but not the point and it was o/t) got double pay for the bank holiday. This riles me a little because their getting a benefit for very little sacrifice and im getting none for a bit more sacrifice. I dont understand what i couldve done sunday that someone who works the monday wasnt able to do?! IYKWIM?!?

    I say fair play to ASDA for recognising which staff are sacrificing more, sorry OP. Also have you checked your not entitled to lieu days as so companies do this.

    They have no obligation to pay anyone extra. They can't have some staff getting extra for the 1st and others for the 2nd. ASDA made the decision that any extra pay would be for the 1st and that's up to them.

    Torry is unfortunately correct, there is nothing in employment law that states that companies have to pay staff any extra for Bank Holidays. They could if they wished, just ay the standard rate of pay. I suggest everyone who has problems in Asda, especially any problems relating to bank holidays, or pay, to join the GMB Union, they are recognised by Asda, and the GMB have had some great successes within Asda. Colleagues can join on line at gmb . org . uk

    If you work more than 20 hrs a week, you are looking at £11.27 per month. If you work less than 20hrs a week, its just £6.29 per week.

    Forget Asda Law club,its run by Asda, through a group of solicitors from Sheffield, Asda is not about to pay solicitors to sue themselves......................................
  • it is very true wall-mart in usa hate unions their is a one hour video on it on youtube. I guess we are lucky here in uk we have union rules and laws which came from the 80's minor strikes. But saying that asda does seem to discourage people joining unions an example of this is all leaflets left out in the canteen seem to go missing in a short time.

    The union in our store has been fighting to get fair pay for us as we believe we should be classed as a depot not a store.

    Asda treats its staff just wrong they will ask for our help when things go wrong but when our back is turned stab you in the back I dont blaim people refusing to do over time. I still don't understand how asda gets away with not paying time and a half when you have worked over 40 hours it seems alot of rules out their make employers pay over time rate at time and a half in other company's.

    I also hate how Asda monitor what people say on facebook we dont tell lies we are honest but I guess if the staff said what they thought the company might look like a bad employer.

    Actually, they were extremely significant strikes.

    My son works in a local Off-License / Convenience Store, Bank Holidays are not a compulsory rule that gives him extra pay and / or a day off. He does manage to get some of these off but my research suggests that it isn't compulsory. :(

    Surely the thing here is that the 2nd of January 2013 is not a bank holiday in England and Wales - I am back at work on this day as normal.
