  • Since you spent time in retail, I'm sure you have found plenty of situations a lot worse than mine.
  • Oh and batteries are consumables, with limited life. Buy a new one and move on.

Irrespective of the OPs complaint, laptop batteries are in no way consumables no matter how much retailers might try to pretend they are.

Hi everyone, I have a question about the actual terms of a warranty. I bought a Compaq laptop from Harvey Norman on 10/12/2010 with a 12 month warranty. I noticed recently that the battery was lasting very little time on a full charge so took it in to Harvey Norman today (28/12/2011) to get a new battery under warranty.

Of course, they said that it was out of warranty by 18 days but I argued that it says 12 months warranty (December to December), not 365 days warranty.

Anybody have any idea on how this works?

The laptop is out of warranty. However, it is still covered by the Sale of Goods Act. This states it should be of "satisfactory quality", and this includes durability.

You could argue that it is not of the expected durability, and should therefore be repaired/replaced/refunded. However, there are a few things to look out for:
    - if the retailer disagrees, it will be incumbent on you to prove the item had an inherent fault (rather than misuse) - you will need an engineers report for this.
    - there is no fixed definition of what length of time it might be expected to last
    - if they offer a refund, they can take into account the use you've had of the product
    - You may need to threaten and proceed to small claims court, and there's no guarantee you'll win
