Received an N5B form without an issue date

Hi,
I received an N5B from my local county court as my landlord is seeking an order for possession against me.

The form seems to be completed OK, and has a claim number and a county court seal stamped on it, but it does not have an issue date on it. The issue date box is empty and there is no court stamp bearing an issue date either.

What effect, if any, does the lack of an issue date have?

Any help would be much appreciated.

The N5B came in the post today. The envelope has a postmark with Dec 22nd but, as I mentioned, there is no date at all on the form.

Is there a date where it says statement of truth ?

Call the court. They will advise on process, though not on law.

Secondly what notice to quit the property has been "served" upon you prior to the form arriving and how was it served.

Well, it's a bit complicated. I do not believe that notice was ever served, because it was supposedly done by hand, but I definitely never got anything.

However they have submitted a statement from someone at the letting agent, saying that they delivered it, so I am not sure if I can really contest that.

Thanks, I'll do that. What I really want to know is if a lack of issue date is grounds for a defence. I'm not sure whether that falls under process or law.

Yes, that is dated Dec 12th.

How does the statement describe the "delivery"

  • I assume you didn't pay the rent and are now looking for ways to get longer at the property for free?

Are you just assuming or do you have a basis on which you are assuming?

If they did not serve notice, then you can and should challenge it. Courts do not exist to rubberstamp lies from Letting Agents.

Have they also provided a 'further' copy of the notice which they said they previously supplied? So that you can check that its purported contents were in fact accurate (or not) nevertheless?
