Vodafone Upgrade Contract - Can She Cancel?
Options
Hi all,
I'm posting this on behalf of my girlfreind who without letting me know 'upgraded' her phone on Friday instore but basically didnt get a good deal.
The deal she was given was the same really but with a new phone - which in her words is worse than her old one! She is paying £20 a month for 125 mins + 250txts but i know she could have got a better deal elsewhere ( three network for example)
She sometimes uses alot more than 125 mins, last months bill was £37!
I have read through the terms of agreement on the Airtime agreement sheet but couldnt see anything about cancelling, is she stuffed?
Hope someone can help.
Thanks in advance guys.

You have a 14 day "cooling off" period where you can return the phone within the 14 days and only pay for your usage (calls/ text/ lin rental for 14 days).
By returnig the phone it should also cancel out the new contract term.
Call customer service whilst in the store to make sure they have done it correctly though as sometimes they pass the buck and if your in store you can let the store talk to customer service to sort it out.
If it's in her name & address then only she can cancel and return it. Smile, you only get one life, LIVE IT.0 -
Thanks -1- for the reply.
I have just looked at the Vodafone website and found this under the terms & conditions:
"Please note that, if you are purchasing a contract phone you will lose your right to cancel your airtime contract under the Distance Selling Regulations upon connection of the mobile phone. You do have the right to return the phone and cancel your airtime contract within 14 days, though you will be liable for line rental charges and any calls you have made during that time.
If you are purchasing an upgrade you agree to extend your airtime agreement with us for a further minimum period of 12 months"
It's the last sentence which gets me thinking, does that lose her the right to cancel at all?
Thanks again.0 -
Unless they have changed their terms you should still be able to return it.
When I upgrade (with Vodafone), I test the phone for a week and if I don't like it, I just return it and keep my old phone and old contract ( so nothing is renewed).
But like I say they might have changed their terms by now, I last upgraded and returned in Jan 2006.
No harm in trying though, it should be fine and the worst they can say is no. Smile, you only get one life, LIVE IT.0 -
Thanks again, think i'll print the terms out just in case they try and pull a fast one on her.
She's not too happy with what shes been offered and nor would i!0 -
The instore terms & conditions may very well be different to the online ones - as face to face sales are not covered by Distance Selling Regulations.
Check what information your girlfriend was given (and still go and try to get it cancelled anyway - no harm in trying!).
