Car insurance

Hi can someone help . I have been with my car insurer for a few years . I recently purchased a new car and sold the other one . I phoned and updated them . My forms came through the post and I started paying my monthly DD . my handbrake failed on a hill recently with no one in the car and rolled down a hill and hit another car , after contacting my insurer they tell me that an error was on my certificate and it doesn't start till 28/12/11 . I've had the car over a month and paid my first installments . It was ment to say 28/11/11 and my schedule and credit agreement states 28/11/11. Just an error on the certifiicate , they say that I haven't been covered for the last month so doesn't want to pay .

    Ask for a transcript/recording of your phone call, then take it from there.

    Make a formal complaint ASAP. They can check the phone call recording and if there error is theirs they will have to deal with the claim.

    An error on their part does not absolve them from responsibility. An error on your part may well do.

  • Thank you . I've already asked for that and asked them why did they take a payment before my insurance was even about to start if they believed it was the 28/12/11, as my first payment wouldn't of come out till January . They said I just have to wait until they listen to the recording but could be sometime in the new year . Which leaves me with an unhappy neighbour

    Was that just the serviceline or have you escalated it to a formal complaint? It may be quicker to get it escalated to complaint if you havent.

    Your neighbour should still put in his claim direct to them now.

    If he has already done this, and been told that your insurer can't help as they weren't covering you at the time of the incident, then he could write to you asking you to pay for his damage, and you can pass on the correspondence to your insurer to deal with.

    THis may concentrate their mind on sorting this out for you!
  • Formal complaint . They Said it will cost them over 500 to submit the complaint but they have no idea when it will happen . Just have to sit and wait apparently
  • My neighbour is prepared to wait to see how this turn out . There is not too much damage to the cars and will offer to pay for it if it goes on too long .

    As your schedule, and credit agreement state the correct date, you need to escalate the complaint to the FOS if the insurer do not admit it's just an error on the policy certificate.

    You can include a claim for the time you spend, and a sum of £10 for each letter you need to send to settle the claim.

    Send a written formal complaint to your insurer now, and telephone the FOS to see how soon you can escalate it. They may contact your insurer informally and resolve it sooner.

    Just to add:

    Make sure the complaint is headed with the word "Formal Complaint" and you send the complaint by recorded signed for or special delivery. That way the insurer cannot claim that it wasn't a complaint or they have lost the letter.
    I'm not cynical I'm realistic :p
