Short changed by a newsagents kiosk and they refused to rectify it

    Strictly speaking, yes. In the OP's example, £10 was offered in return for a newspaper. It's common practice that change would be provided, but there is no provision in law for this.

    I imagine it could be argued that, in this day and age, receiving change is an implied part of the contract that should not need to be negotiated, but to my knowledge this has never been tested in court, and given the small sums usually involved, it's probably unlikely to ever be tested.

    In order to comply with the very strict rules governing an actual legal tender it is necessary, for example, actually to offer the exact amount due because no change can be demanded.

    You wouldn't stay in business long actually trying that one though.

    Don't think any that actually did that in the normal run of events would survive long - but it does mean no good calling the police. They've committed no crime - whereas if you run off with goods you have.

    I think that's a silly assumption. In reality if the punter is short-changed that is theft. The difficulty would be to prove whether it was intentional or not.

    This happened on Xmas eve in Game Store Four Seasons Mansfield in Nottinghamshire.
    My son wanted to buy 2 games with money his nanna had given him (my amazing mum who still thought of the grandkids even though we had just buried my brother micheal that day she couldnt afford it but insisted as it would make her happy.)
    So i took him to GAME mansfield where he chose 2 games that came to £22-98 a little over the £20 note he had which wasnt a problem as i gave him another fiver to cover excess.
    He handed the games and the money (1 £20 note 1 £5 note) to cashier who then swiped my game card and informed us there was £7-50 on the card would we like that taken off price of course money is tight so i said of course he then told us new ammount was £15-48p did we have the 48p so with the £25 still in his hand i gave him a further 50p he then handed me 2p change and was struggling to put the £20 in the £10 drawers slot not the push in safe for £20's and before he even closed the till drawer i pointed out his mistake.
    He suddenly turned from polite and intelligent to quiet and kept peering at the reciept i explained he was given the £25 and a further 50p but he just shook his head and kept looking at the till reciept he eventually said only the store manager could open the till for a refund.
    He went in the back and a lad in his 20's came out said he would check till which he took into a back room for 20mins and came back out saying the till was correct and was in fact 2p down.
    Having just watched them put my sons £25 in thier till i was justifiably upset at this he then told me theres nothing i can do after all anybody can come into the shop and claimed they had been short changed which was a bad move on his part i explained i hadnt come into the shop he had done it there and then and i had explained before he closed his till.
    His reaction then was to say sorry again and ask me to leave shop which i refused to do so until the had reimbursed my son his missing money he then called in security and intimidate me into leaving (its my job so this tactic was never going to work) they was politely told to stand 6ft away and just observe whislt i dealt with the problem.
    Looking at the so called store managers name tag i was evident he wasnt the store manager and was a temporary assisant manager not who i had asked for eventually the real manager came out and still refused to rectify his employees mistake as it must of been mine.
    So my son is £10 down and GAME refuses to deal with it they apparently have no cctv in thier store so it cannot be reviewed (since i could see the cams in the ceiling this is an absolute lie.) and the shop can happily short change you as long as they can say they checked the till in secret and as far as they was concerned the till was correct and i was treated like a thief for asking for my sons money.
    I contacted the police as i felt they had stolen his money but they refused to deal with it as it was a "civil" matter as it would be hard to prove they had taken the money.
    Im currently considering legal options (the ammount is irrelevant its my sons money given to him by a grieving nanna that is massive to me) anyone got any advice ??

    Shaunt, write to their head office in hampshire and tell them what happened. Let them know that they have a dishonest employee in their Mansfield store who is robbing customers and ask them what they intend to do about it. Their address is on their web site. Good luck.

    Spoken to consumer direct who are waiting for thier head offices reply.
    And yeah post was long its part of my job to provide details a habit i cant get out of it seems.

    this happened to me once. I contacting HQ i got a cheque for the full amount back with an apology and guess what a week later all the staff in the store were changed
