    They could have sent the dress away for testing and then came back with a partial refund. Bearing in mind that the impression I got from the OP's post was that they had bought it in july, went on holiday in October but only recently (Dec) tried to return the dress. They don't have to offer a full refund and the only time you are allowed to demand a full refund is non-acceptance. Once a reasonable amount of time has passed, it would be deemed that the customer has accepted. I would say more than a reasonable amount of time has passed.

    They were actually doing better than they had to by offering the customer a FULL refund, just by way of a gift card.

    Surely if it was a fault with the actual product (which is the reason I believe op or someone gave for not having a replacement), then they would have been made aware of this by a huge number of customers returning theirs. If no one else has returned theirs, it is (on the balance of probabilities) not unwise to assume the fault does not come from the product itself.

    OP would be better contacting customer services/writing to head office and getting their take on it. They may be able to arrange for a refund with the store in question by contacting the store and telling them Mr xxxxxxx will be returning a dress, please issue a refund.

  • Whilst it would (probably) be within the rules I would find it a bit distasteful if they made a deduction from the refund for something that was only 3-4 months old! I have only ever come across proportionate refunds when it is at least a year old.

    But I agree, a letter to head office should sort it out.

    The problem with principles is sometimes they serve no purpose other than to make the holder of said principle righteously indignant. Righteous indignation doesn't get you a refund for your item, but I guess it allows you the opportunity to chunter away on the internet.

    The employee's job title and the date would be more than enough to identify him. The big retailers use digital rotas now so Head Office would be able to find out who you dealt with at the click of a button by looking at the staff schedules. Similarly, all it would need would be a few clicks on the internet and you'd be able find out his address from 192.com / facebook page / twitter feed by demanding his surname.

    Just because you say you're not a weirdy who would do things like that doesn't mean that you're not. And even if your intentions were perfectly legitimate doesn't mean there are people out there with ulterior motives, who wouldn't take this situation as a personal grudge and look into the employee's private life.

    This person isn't just a Tesco employee with a personal agenda to p**s you off, he's a person with a private life and family he wants to protect.

    It's bonkers that you think he's being difficult by not providing his surname.

    Thanks Thumbremote for the most sensible reply.

    Also to correct some bad guesses the dress was £8 not £2. It's not a big amount. And as I said we would have accept the gift card had the situation been handled better. It started with Tesco being antagonist when we were being reasonable and just saying look the dress is faulty. Also we presented the original receipt. Tesco is 25 miles away so not somewhere we visit that regularly. And it was some weeks back we tried the return. I just thought I would share it.

    There is no danger of Tesco not paying up in the end. They are in the wrong and yes consumer direct agrees.

    Any who knows the song 16 tons might be aware that workers used to be paid in tokens that could only be redeemed at the company store. I think it was from that that the law enshrined the right to be paid in money and that tokens or credit notes were NOT the same. The consumer can opt to accept one but does not have too. If SOGA says a refund is due then as the item was paid for is the requirement unless the consumer accepts something else, such as an equivalent item or a credit note aka cash card.
