    Why is it malicious if you buy to resell? I do it all the time.

    Of course it's not but from what the OP said here (I haven't read the other thread), if the buyer buys to resell and then negs after failing to resell because the OP won't accept a return, which would amount to an unagreed 'sale or return' basis, I'd say that was "malicious" and eBay would probably agree.

    got to agree with soolin on this one,if they want to sell on fair enough,the buyer has lots of the items she bought from ebay on her online shop and facebook page.good luck to her,but she has to take the profit and loss she makes on the items she resells as just the nature of the business

    That's my point, she buys to resell (from what you just said) and there is nothing wrong with that at all but demanding a refund after trying to sell is malicious as far as eBay are concerned. Unless you have an agreement with a supplier, such as sale or return, a business can't just return something because they couldn't sell it and neg you for refusing.

    I would report your issue to CS for review.

    ludovico there are actually two other thread about this transaction which makes things a little more complicated and I am speaking with the benefit of remembering them.

    basically though buyer asked for a refund as dress was not as described- but it looks like the request timed out without buyer persuing it.

  • Thanks Soolin, that's a little different and in that case perhaps not malicious. Sorry to be lazy but out of interest did the seller actually sell the dress to someone else and then claim NAD or did she just claim NAD and then list it for sale?

    she tried to sell it first the raised an NAD,she said the item was not the correct length but in my description it said it had been shortened to my partners height,anyway thanks for everbodys advice
  • I see, if she had sold the item and her customer companied and she in turn complained to you the feedback would be removalable (if the eBay messages backed this up). Best just to let it lie and possibly add a follow up to your neg as suggested in #9
