And your post fails in the first 2 words....(I've bolded them for you).
I don't see where the negligence on PE's side is, nor can anyone else aside from the OP.Thinking critically since 1996....0 -

I was posting in response to someone who was asking about the level of compensation that would be appropriate. I made no judgement one way or the other as to whether there was negligence, and suggested that the OP should contact a solicitor to get an experts view on whether there was.
I have no idea if the restaurant was over filled or there is any other issue of liability, and nor do you.0 -

Well said.
It's amazing the crap the OP has had o take when he is just venting over something very nasty that happened to his sister and could easily have ended a lot worse.
You'd think that some people don't have anyone they care about enough to get annoyed when something very nasty happens to them.
OK, PE may not be negligent but this is a 'vent' forum so just allow someone top let off steam, for God's sake. There are two types of people in the world: Those that can extrapolate information.0 -
So how much exactly are you wanting to scrounge out of them for an accident which wasn't even their fault? And to pre-empt anyone calling you out that you're just trying to profiteer you've chucked in ye olde argument of last resort that it could be a child next.
Restaurants moving tables around shocker! Our local one moves tables next to and away from each other all the time depending on the size of parties of guests that come in! A complete stranger dropping glass shocker! Well obviously the restaurant is directly responsible for their klutziness - they should just turn away all badly coordinated people, or people with grip issues at the door having conducted a full risk assessment of them, or give them kiddy proof non spill sippy cups.
Just admit you're trying to screw the maximum you can out of them and people would respect you more than trotting out the "lessons should be learnt", "it might be a child next" garbage in one breath and then the "well they've offered us this but I'm not happy with the level offered" in the next.Little miracle born April 2012, 33 weeks gestation and a little toughie!0 -

Hard to believe, I know, but some people really don't like the idea of a child being blinded - even if there is no money involved. There are two types of people in the world: Those that can extrapolate information.0 -
I would have thought if there were any claim to be made it would surely be against the person who dropped the glass!0

And on here it blatantly gets used when people know they're going to get called out for just being on the grab for money - because it suckers in people who don't read the whole thing and just see the kid sob story... week in, week out - anyone who comes on with a pointless compensation-grabbing "vent" uses it.... "the dog food wasn't what I expected - it could have been a child eating it!"... "my lettuce had a snail on it - it could have been a child next I need compensation so lessons are learnt" ... etc etc
Then we get the drip feed, oh I'm losing the thread tactic where someone gets told they're taking the michael... so halfway through they change from "I want my rights and my compensation" to "I'm just trying to make sure lessons are learnt cos it might be a child next in this completely unplausible scenario but I want to curry favour and get some people on my side and there's bound to be someone daft enough to start waving pompoms in my favour if I use this line."

I would agree that the 'child' part was not particularly relevant but people do worry about children a lot more than they worry about adults.
And getting a shard of glass in you eye and needing hospital treatment is not a trivial inconvenience.
Try and get a sense of proportion. There are two types of people in the world: Those that can extrapolate information.0 -
No wonder insurance is so high. Everytime there is an accident people want financial compensation. It's a horrible mindset we have developed over the last ten years.
This was an accident, no one's fault (unless PizzaExpress have been negligent in either the over-crowding or the use of glass). These things happen, it is unfortunate, but it wasn't done deliberately so accept the £50 voucher and move on. I have a perfect sense of proportion - people drop stuff in restaurants, glasses don't bounce well... the general public sometimes screw up - and this money grabber wants to hammer the restaurant into the ground financially for it.
Would they be doing the same if it was a child who dropped the glass?!Little miracle born April 2012, 33 weeks gestation and a little toughie!0
