Ely Station: Parked outside bays

Dear All,
I did add a reply on a previous post about this, but then read the sticky (about starting a new thread) so apologies for double posting
About 2 weeks ago I had to be in London for the day. No spaces at Ely station (as usual) but got tucked up next to a kerb. Usual cars on grass etc. I was not in anyone's way, nor were others and have been doing the same for years when I need to be in London.
Home at 7pm, mine and all the other cars have tickets. £50 raising to £75 tomorrow. I was livid!!
Wrote a letter to the appeals address when I got home explained the above and asked that fine be waived based on past precendents etc. Heard nothing back to date.
I was about to pay--up tonight but googled to see if anyone else was in the same boat, and found this site

My question then is this: Can I still ignore the PCCN having made the foolish mistake of writing to them at NCP?
I included all they asked, name addy, car No etc etc. so they know who I am for sure... Do I just have to cough up this time?
Advice appreciated (wish I'd looked sooner)!

This is what I said:
Parking Contravention Charge Notice
Dear Sir/Madam,
This evening (6th December 2011) I returned to my car (a ....make and model only provided.....) parked at Ely railway station to find a parking ticket had been issued while I was at work in London. The ticket issued was described as : Parking Contravention Charge Number CP.............. (photo-copy included here). I had bought a parking ticket for the day costing £4.40 and this was correctly displayed (also copied here).
Several other cars had received tickets, I suspect for the same contravention: Their drivers also seemed to have bought parking tickets.
It is true that my car was not parked inside a space but was not causing any obstruction to other drivers or car park users. Neither was any other vehicle which had been ticketed.
This car park is too small for the station it serves. I have been a regular customer of NCP and Ely station and have often be forced to leave my car in a similar place due the lack of parking spaces.
On every occasion I have left my car parked outside the bays, I have observed several other vehicles already parked in areas of the car park without bays. This has been the situation for approximately four years. In that time I have never seen a parking ticket issued to any car parked outside of the marked bays, whether or not my own car was in a marked bay. That’s a substantial precedent for this practice being tolerated and seemed very reasonable to me. People have to get to work don’t they?
When I parked today there was no new signage to suggest that the situation regarding enforcement had changed. The lady who sold me the parking ticket did not mention any change.
I would therefore request that the £75 charge be waived on this occasion. This seems fair given the past history regarding enforcement.
Please consider applying discretion in this case?

Just intrested about the lady who sold you the ticket . Was the car park full to capacity when the lady sold you a ticket ??0

yes the carpark was full already but I had found my 'space' and she works in the station ticket office so cannot see the car park.0 -

Bearing in mind this is a Railway Station, I'd look more closely at the 'PCN'. Not often, but occassionally Train Operating Companies (TOC) use real PCNs (Penalty Charge Notice) to enforce the Railway Byelaw applicable (14). As I said, it's not that often, but bear in mind it's the owner that's liable for a PCN in this case and not the driver, as fake PCNs indicate. If it's a real PCN, then you should not ignore, as it'll end up at the Magistrates' Court. If it's a usual fake one, then just ignore. TOCs would tend to issue a real one themselves as opposed to getting an agent to do so on their behalf. Having said that, it's not beyond the realms of posibility so beware. It should be made clear on the reverse of the PCN as to what happens with appeals etc. Usually you would appeal the ticket directly to the TOC's prosecutions Dept., but if ignored or appeal lost and the ticket not paid, it would go to court, and not County Court as it's a criminal offence. Also, if County Courts are mentioned anywhere, I'd say it's a fake, as they'd only prosecuting the T&C breach not Byelaw.0
