Right - I've now spoken with the land registry and apparently there is a person with my name living in London who has been made bankrupt. Therefore they have written to all the people with the same name (Which includes me), to claify if we are the same person.

As I never received the letter they automatically put a B10 notice on my property

I question, why have they sent me the letter as we don't live in the same part of London and the DOB are different. Apparently they have to by Law and its for me to prove that I'm not the same person

So now they have put a stop on the B10 and are re-issuing the form that I need to fill out and send back.

What a waste of tax payers money and my time for assuming we are the same person even though we live it opposite sides of London and our DOB are different.

Hi sultanad, frightening that can happen and don't blame you for being mad!! Glad it is sorted out now

    Best wishes

ahhh such nievity, unfortunately as a fine upstanding member of the community you probably dont consider the otherside. sometimes the petitioner doesn't have the DOB and sometimes the debtor doesent always use the same one for their various debts and assets, imagine if you had bought a house from someone who then skipped the country and the IS later turn up on your doorstep to take back the property you thought you owned. That is why they take the better safe than sorry attitude. They did afterall write to you first and yes it has caused you some inconvenience and a few sleepless nights id bet but the consequences of not stopping a bankruptcy asset being sold could be much worse for another blameless member of the public

It is not the Law, they can not petition a random person, copy all the paperwork and make a complaint of harassment to the government ombudsman .

  • I got home last night to a B10 Notice of registration of a bankruptcy notice.

This had my correct name and our address. We have no outstanding bills and never have had (thank goodness), I'm also not a Director of a company.

After a rather unsettled evening and poor nights sleep I phoned the Land Registry HQ contact centre who advised me to phone the Court. I tried the court in London (no answer) and finally tried the Bankruptcy Office at Land Registry HQ (got through 1st time).

It turns out that someone with the exact same (and rare) name as myself is involved in bankruptcy proceedings (presumably corporate). They have a trainee in the office who'd sent out the wrong letter. I should have received a B10A - "Are you the same person as…", rather than the B10 - "You're stuffed." letter. The office did apologise on the phone several times; they're sending out the correct form today (they were very polite - I'm very relieved).
