B10 Notice recieved, but I don't owe any monies to anyone

    Or does it refer to a bankruptcy order that has already been made?

    This time on a Sun morning, I can't recall exactly what a B10 says. :o

  • The house is occupied by my sister and her family, and I can trust her. She has no loans or debts that need paying.

    Could the Bankruptcy notice be on the house? and as the house is on my name, the land registry have notified me.

    Ah. Wouldn't be on the register anyway then, as whatever bankruptcy proceeding it pertains to would not have resulted in an "order" yet.

    As said, I can't remember exactly what the notice normally says, but does it specifically state that the proceedings themselves are against someone by your name?

    A court/case number and court name listed?

    Clearly the first thing to do would be to contact the court/land registry to find out what the hell is going on.

    The order certainly has the proceedings against my name.

    The court ref and number are listed, but not the court name.

    I will certainly be contacting the land registry and court to find what the hell is going on.

    Surely the B10 letter should also have the company/person who the alleged debt is owned to.

    You would think so wouldn't you?

    But many of theses things don't. They just refer to "proceedings".

    what happens is that the court sends details to the land charges department of the (PAB) pending action for bankruptcy, and this is filed against your name and the address that they have for the person they are making bankrupt, land charges then pass this to the land registry who then place a restriction on the given address if it is owned by the person but they then also search for any other properties that the person might own and place a restriction against them, this is to stop the person wh has the petition against them disposing of assets before the bankruptcy order, they send a notice to each of the properties informing them of this.

    so the way i see it there are 3 possibilities

    1. is the worst, that there is some debt out there that you dont know about and you are in fact being made bankrupt, the most likely culprit being council tax or something like that, ie something you can incur without you being involved.

    2. someone is fraudulently using your details to get credit at another unknown address which is why you have seen no sign until now when the creditor tries to take action and comes accross assets like this property.

    3. it is simply a case of the land charges having little information and so mistakenly thinking that this property belongs to the person being made bankrupt which does sometimes happen if you have a common name

  • Right - I've now spoken with the land registry and apparently there is a person with my name living in London who has been made bankrupt. Therefore they have written to all the people with the same name (Which includes me), to claify if we are the same person.

    As I never received the letter they automatically put a B10 notice on my property :mad:

    I question, why have they sent me the letter as we don't live in the same part of London and the DOB are different. Apparently they have to by Law and its for me to prove that I'm not the same person :mad:

    So now they have put a stop on the B10 and are re-issuing the form that I need to fill out and send back.

    What a waste of tax payers money and my time for assuming we are the same person even though we live it opposite sides of London and our DOB are different.

    I can see that location wouldn't make any difference to them, the individual could have moved to a different part of London. But surely a DOB check would be standard, imagine how many letters they'd have to send if it was John Smith of any DOB!

    Absolutely ridiculous not to undertake such a basic check.

    Having said that, at least you have it sorted now, although I'd put something in writing to them as well and request a written response confirming the B10 has been removed - just to be safe.
    When I joined, I needed a name. The forum members gave one to me...I am INAN :D
