Lender has no record of our mortgage??

1st off Newbie saying hello. ;)


Right to business - we have come to the point with our current mortgage where we want to change lenders due to the discount period ending soon, we are not tied so that's not a problem, but we have yet to have an annual statement off the lender. So the wife phones them up and they ask for the mortgage number . . . we don't have it because they never sent it!! No problem they will search on address, no luck tried names, no luck, tried old address you guessed it no luck, even the direct debit ref no. for the payment they are taking rings no bells. Basically they have no record of our application, the offer or sending our solicitor (now retied) the money. But our solicitor received it and sent it to the house builder. We have been in the house well over a year.
Our mortgage adviser is currently pursue the application we made with them with out giving them too much details to see if they processed it. But was struggling to get any where with them.

Where do we stand and what can we do about it? If they don't think we exist on their system then I take it we don't owe them any money!

    Have you asked Land Registry the details of the mge lenders charge - as (assuming they via their Sols. registered one), LR are unable to release the property from the lenders registration without their authority.

    Without which you new lender won't be permitted 1st charge, and you won't be able to complete unless they are able to secure this.

    So although on the face of it, it looks great ... the registration will certainly cause probs.

    I would also contact your bankers and ask them to confirm the account and sort code no that your mge payments have been paid to, this prob be a bucket account, whereby the ref no under which the bank forwards your monies, will allow the lender to allocated them to your mge account.

    If your monies have not been returned from the lender as "unknown account" they do have your details somewhere in the systems, which seem to have thrown wobbler !

Also we had one hell of time getting it sorted and nearly threw it in and went some where else but they kept promising this n that next week or in a few days, which went on for 2 months - we nearly lost the new house because of them!     They have taken the payment regularly and it's never been returned. We will try your suggestion with LR and confirm the sort code/account its going to.
    We don't expect the whole thing to be simply be for gotten but had considered as a last resort stopping the payments and await the letter demanding it be paid, then at least we will have some point of contact with a reference number.

    Yes, of course, but I just worry if you do that, that your mge will be registered with CRAs as a mth in arrears, and my well predjudice any future mge application. (notwithstanding that the new lender may accept your motive and explanation as to why this occured).

    I would say, use that tack as an absolute last resort - try land reg, and what your Credit Ref Agency report states. This may be a case of a diff/incorrect acc number, and or incorrect spellings of surnames etc being keyed - which has resulted in their current probs sorcing your active account. I know to have so many errors on one account may seem far fetched, but it can and does happen.

    Anythings a possibilty .. !

    CRAs on line (i.e experian, equifax, etc) often have a free initial period (although you do have to registered a debit or credit card at enrolling - just cancel this down to stop them taking payment on the following month). Obtain a copy of your current profile, see what they have registered and take it from there. :)

    Are they taking money out of your bank account?
    If theyre taking money and you have nothing on file with them....where is your money going?

    Get them to look into it. speak to a manager or whoever you need to to get it resolved. You shouldnt have to write in for their incompetence.

    This should be simple, go back to your advisor/broker or check the mortgage offer, that should have the account number on it, they should be able to trace it back from there.

    For this reason, Twiddle should write letters and keep copies. And continue paying. And engage all of Clydesdale's internal copmlaints procedures and take it to the Financial Ombudsman if necessary.

    My bigger fear is that despite paying, it could end up with CRA's, but this will be easily dealt with if the money is still paid.

  • Exactly .... I don't believe stopping paying is the answer here ..... notwithstanding obtaining releasement of charge by the lender on completion.

    If this was a privately sourced adviser, well you know who you used.
