Work sent us home during storms

My work sent us home last Thursday due to hurricane. Our line manager told us shortly before 2pm that we should go home as the weather was so bad.

Today we were told that we will now need to forfeit a 1/2 day of pay or 1/2 day holiday leave (if we have any remaining) for this time. :mad: Surely this illegal, if we were given the option of leaving and losing 1/2 day or staying put then we would have stayed.

Also we had all worked through lunch in order to leave 1 hour early, so surely it is only 2 hours due back? Either way were are all very unhappy with this. The line manager not happy either.

    Your employer can decide when some or all of your holidays must be taken. This may be in your contract of employment, or it may be normal practice built up over time. An employer has to give the same amount of notice as you do.
    You must give your employer advance notice that you want to take holiday. This notice should be at least twice as long as the amount of holiday you want to take.

    So without giving one day's notice you can't be forced to take half a day's holiday.
    A kind word lasts a minute, a skelped erse is sair for a day.

    If you were sent home at their choice, they should be paying you.

    My commiserations - I booked a week in a holiday cottage on the west coast (literally on the west coast :() when the September one hit! My advice is that the Lock Fyne Whisky shop is a great place to last out out - thank you Loch Fyne Whisky shop!!!!

    Yes you are correct - if you employer sent you home and you are given no choice in the matter in law they must pay you.

    Shortly after you argue this into the ground or make a tribunal claim, I am afraid the real world scenario is that you will find that you are redundant, or some such.

    Legally you are correct - but there are times to pick your battles and this may not be one of them. But that is your choice.

    Presumably your contract specifies your working hours so if they decide to cut you down half a day then thats down to them.. be warned though they might instead ask you to make up the time (which they're entitled to do) if you argue that you want the money.

    Your best thing is to look at your contract of employment.

    I agree it's not worth picking a battle as having enough problems geting TOIL days I am due before the end of the year. So I'm afraid I will not be making up the 2 hours.

    If you have TOIL outstanding - couldn't you ask for it to be deducted from that?

    There NEVER has been and there NEVER will be a hurricane in the UK. Faux "hurricanes" created by the media aren't hurricanes.

    Anyway, as the question in hand, who has decided that you should all take 1/2 day to make up for it? Presumably it isn't the HR department trying to create problems by trying to make decisions outside their remit.
