Gym ringing me even though I didn't leave my number

  • Next time they phone just tell them that you want your number off their system and that they have now lost a potential member by contacting you when you didn't want your number taken. If you are still interested in joining they may give you a discount! :P

    I suggest that it is reasonable to expect any salesman to ring you if you give them your phone number, whether intentionally or not.

    This is not cold calling which would be covered by the TPS.
    It is a followup call (or calls) in an established relationship.

    OP didnt "give" her phone number though. They took it.

    And while on its own may not be a big deal, the fact they asked for her number and she declined to provide it should have been a very clear sign the OP objected to them retaining and using this information.

    Live marketing calls should not be made to anyone who has registered with the Telephone Preference Service (TPS) or the Corporate Telephone Preference Service (CTPS), unless they have told the caller that they wish to receive such calls from them. They should also not be made to anyone who has told the caller directly that they do not wish to receive marketing calls.

    Organisations that hold your personal information must use it fairly, keep it secure, make sure the information is accurate and keep it up to date. You have the right to expect this from them.

    When organisations collect your information:

    they should usually be open about why they are collecting it;
    they should only use it in a reasonable way that you would expect; and
    they shouldn’t use it in a way that is unfair to you.
    In some cases organisations do not have to be open when they collect information, for example when the police collect information about a suspect during an ongoing investigation. Openness is the general rule though, whether you’re dealing with an official body or a private one.

    A privacy notice should say:

    who is collecting information about you;
    what it’s going to be used for; and
    whether it’s going to be shared with other organisations.
    This is the legal minimum

    Telesales

    You must ensure that people you are contacting are not registered on the Telephone Preference Service (TPS). If they are registered or have already asked you not to call, you cannot make an unsolicited direct marketing call to them



    As someone else said OP, put your complaint in writing to them requesting they cease to process any personal information and erase any data they currently hold.

    Oh and for whoever said about the phone number appearing on their mobile and they could call it anytime, DPA rarely ever applies to individuals so that ones a bit of a no brainer ;)

    I'd say the easiest thing to do would be to wait for them to ring again, then say 'hold on a second I'll be back' then leave them on hold for 15 minutes :)

    Honestly, some of the people on here truly amaze me for how over the top you go. Surely it's easier to answer the phone, tell them your no longer interested and then it's all done.

    You lot must have far too much time on your hands, I couldn't go to the effort most of you suggest for such a minor trivial thing.

    If she hasnt answered the phone and its went to voicemail then the only thing she's been over the top about is saying its harassment.

    It still doesnt excuse them for their actions.

    Its bad enough having to deal with pushy sales tactics when you wander into a store, never mind in your own home when you have either told them or insinuated that you do not agree to them calling you or retaining/processing your personal info.

    Nor is it a trivial thing when you're receiving phone calls dozens of times a day for someone you've never heard of when you're trying to sleep as you work nightshift and cant turn the phone off because both your parents dont keep in great health. And yet they still persist in calling no matter what you tell, how you tell them it etc. Like bod says, not everyone does as asked/told/should. If they did, this board wouldnt exist!

    They've called three times. I very much doubt she said 'Still thinking about it. I'll let you know next time you ring!'. I suspect she's said she's not interested but they keep calling.

    Sorry I should have put they were bothering me (have been harrassed by someone in the past, so know the difference)

    I will put a complaint in writing, unfortunately they always ring when I'm at work so I can't ask them to remove my details.

    I repeatly told the receptionist that I didn't want to leave my number and that I would call back. This is what I'm most peeved about. She ignored my request.

    And no, I'm not going to join this gym, I will probably join my local leisure centre

    I don't think that TPS applies here, because the OP called the gym in the first place and thus made the initial contact.
    The OP (knowingly or otherwise) gave the gym the phone number, by virtue of not choosing to withold it when making the call.
    In terms of stopping the calls, the best approach would be to simply say "please don't call me again".
