    i dont accept that.

    As G_M points out .. we have a legal duty to comply with LL&Tenant legislation and especially the Gas Regs... how we do that is our problem.. even if it does cost £4k the law demands we pay it and comply if that is what it takes.

    there was a Yorkshire landlord who did not gain entry to his property because the tenant refused him entry. The gas boiler developed a CO leak, and the tenant got brain damage. The Landlord WAS found culpable and was found guilty and fined an enormous amount of money, necessitating the sale of his entire portfolio.. This whole tragic case ruined the life of both tenant and landlord.

    As landlords, it is our worst nightmare - a tenant dying and it being our fault in spite of best efforts.

    Would be good to know the details of LL's actions and of the overall case.
    But that might support the assumption that peacefully gaining access (e.g. with key when T is out) for a valid reason is fine.

    it was a case in a lower court and so has not set a precedent on which others can rely unfortunately. It was a few years back.

    I had a first inspection last week since I moved into a new place in October, and the lady doing the inspection said they do them to see if the tenant is keeping it clean and tidy. She wasn't interested in repairs - just the housework! We'd also got a list of things together we wanted to discuss with the letting agency, but she was from another company that just do inspections.

    Clutton has been asked on a number of occasions in previous threads to give the details on the "case" to which she refers but has not seemed to be able to.It seems to follow on from someone else's post in another forum, equally lacking in detail. Quoting a case without the full info ( not even name and year) means that the reference becomes pretty useless.

    My bolding. As has already been said - how a T chooses to live during the tenancy is none of an inventory clerk's/LA's/LL's business unless damage is being done to the property or its furnishings. The T is fully entitled to use the property as their home & that includes being untidy etc.if they so choose.

    Some of these people seem to be stuck in a time warp.

    Write a friendly letter to the LL explaining that you are unhappy about personal comments regarding your lifestyle being made during the inspection by the LL's designated agent, and you felt he should know.

    Add that you are happy to cooperate with future inspections provided they
    a) are not excessivley frequent (6 months?) and
    b) focus on the relevances - checking for damage and identifying repairs

    Finally list all the issues you have that the agent refused to discuss, and ask for a timeframe for them to be resolved.

    Who needs a fully detailed inspection after three months?? They now have 25 digital photos of every inch of our home! The report even states that there is no damage and it is completely clean. Time for some angry letters.

    Carezza - it's completed understandable that you are annoyed by this idiot's letter but as RAS says probably the best way to deal with it is to ignore it. Don't get locked into a battle over a moronic LA's comments.
