Is it legal to drive with my boot open.

    and if it's the passenger one, they can poke the poles out of the window to reduce the overhang at the back,.

    There have been several instances of drivers doing this and hitting people on the pavement, and indeed I believe at least one pedestrian has been killed by some idiot doing just this. This is a very dangerous thing to do and if he is seen by the police, any driver will deserve a ban.

    Dangerous condition can be dealt with by a ticket, so where does your ban come from?

    Mistaking £60 with £80 is forgivable, but saying the police will ban if they see someone driving with an overhang, as suggested by poppasmurf, is rubbish and does need challenging. It's not even up to the police who gets banned and who doesn't.

    Surely 'driving without due care and attention' is the law that covers this. Often open to interpretation by the police. Now im not sure on this but i thought this didnt carry a fixed penalty and therfore could result in 12 points and a ban. Especially in a situation like post 22. I work at a diy store and often load customers cars. Once it gets to a point i believe it is unsafe to drive make the driver aware of my views and recomend they do a couple of trips. More often than not im ignored and yet to see any repucussions of this at work. However my mother lost her best friend in a motorbiking accident where a window cleaner drove upto a junction with the ladders overhanging at the front resulting in her friend nearly losing his head, as i said unfortunately there was too much trauma and he passed away.

    Careless driving is 3-9 points.

    If you kill someone you could do 14 years.
