eBay car not as described - unpaid item strike

Friend bid and won a car on the bay of e. Went to collect it but after a good look found it was not as described in the auction. Friend walked away.

Now the seller has opened a case with eBay and so a non-payment strike is pending.

eBay don't seem to allow any buyer rights within the Motors part of eBay. So basically you have to either buy a lemon or put up with a non-payment strike.

What a farce.

So your friend replies to the ebay case saying item not as described, with all the details as to why, and that should be the end of it?

I thought a non-payment strike was pretty much a non event unless you collect [STRIKE]three (?)[/STRIKE] two over the space of a [STRIKE]month[/STRIKE] year so unless your mate makes a habit of it there's no problem

I suppose if he CBA he could argue it with ebay but then it gets into he said/she said but I bet ebay would let him off.

  • eBay don't allow you to reply with item not as described to stuff sold within Motors.

He will probably leave neg feedback though.

There's a bit of a difference between something not as described, and something not described at all.

    "Ford Escort, 1995, blue".

Could be perfect, or an absolute wreck. Onus is on the buyer to check before bidding under those circumstances.

The only time I have any sympathy for you is if the seller implied that the locks were OK (by stating no faults etc). Personally I think eBay should be coming down harder on time-wasters, and by that I mean any stupid bu99er who bids on a car unseen.

Actually that is a few years out of date now. Strikes on their own still mean nothing- so if OP only gets one then that will always be fine. However get a second one and they will find themselves blocked from bidding on most sellers auctions as we can now set our preferences to automatically block buyers who have had 2 or more strikes in a 12 month period.

OP, I might be tempted to phone ebay and aks for advice- whilst it might achieve nothing it can't hurt.

Don't worry about the unpaid strike. I have my sellers preferences set as tight as I can in my favour but the highest unpaid item strike setting is so poor as to be worthless.

You do get some prats as well.
I sold my wifes omega cdx estate on e.bay, it had only been to the shops and back, I had never seen a 7 year old car in such condition, it passed a full mot first time with no advisories and to be honest it was like a new car.
Guy turns up with £1100 which was at least £1500 less than they sell private, and starts to moan about a single stone chip on the bonnet, thats all he and his mechanic mate could find .
Tried to barter down to £700.. no I said, Thats all we have brought with us £700 ! Take it or leave it..
so cheekily he asked for a lift to the station with his mate, OK I said, drove them a couple of miles and stopped outside the vauxhall dealer, get out lads, but this is not the train station, no I said its a vauxhall garage, where if you want a new car for £700 you can go haggle with them and see where you get.
Out they went after some grumbling.
I took the car to the auctions and it fetched £1950, so what on earth they expected for £1100 for a 48k mile car I will never know.
