    I just got 1 from the hospital aswell, even tho was parked in a disabled bay with a disabled badge. Anything happened to anyone from here yet?

    I certainly did, but no one has posted any updates since, ie any more letters. I aint paying it, so they can do 1 anyway.

    I have had three letters and no apology despite my emails etc.

    Im so mad about this but its the least of my problems at present so Im not doing much about it.

    What exactly does the 'ticket' say ?

    A local authority fine issued has the law behind it, the PPC has no law whatsoever behind it and is, as I said earlier, an unsolicited invoice and have no more legitimacy than a Nigerian email invoice for PCN money. Look carefully at the 'invoice, does it say penalty .. .. if it does it's an unsolicited invoice. It might say something like "blah blah requests a cheque payment to be made out to and offer an early pay discount" - that's not a fine its an unsolicited invoice.

    Breaking the law is decided by a court and has a fine attached to it. Breaking a 'deemed contact' may result in an unsolicited invoice from a hospital or one of its contractors but which has no statutory powers to issue fines. If the hospital concerned uses ParkingEye as an agent [ not a sub contractor ] the the hospital itself could take you to [ law ] court but they would then have to fulfil all the legal requirements including proof that you were guilty - - precisely guilty of what, do they have a forensic quality photograph of you actually in the act of driving it / sitting in the drivers seat in charge of it / at the time ? And in all of the above two paragraphs I've not even begun to get into disabled parking bays / and / or / Blue Badge. Even though the blue badge scheme privileges are for parking on-street only, in this case the privileges of free Blue Badge parking are permitted.

    Look .. .. these nasty clamper's do the disabled a service, if the were not there carrying out their insidious practice the disabled would never ever get into a disabled bay .. .. ever .. .. they would be chokka block with chav's hogging the bays until they could find an empty car with a satnav left visible, in addition to the fact that even without the chav's the yellow lines / cross-hatching / permit only / obstruction problems would be rife. The whole multi mi££ion pound industry and its procedures and architecture are designed to do just one thing efficiently .. get you to give [ they can't make you ] them money. When an institution like your local hospital gets on the money~go~round with these unscrupulous companies they hospitals are clueless about protecting their disabled patients. I'd love one .. .. just one person to take one .. .. just one hospital trust to court for 'Hate Crime Against the Disabled'

    Don't pay .. .. what does your invoice say ? .. .. what [ in law ] can they do to you if you ignore them ? .. ..

    PPC's the clamper's in this case ParkingEye rely on the law of contract,

    It does seem very naff that these people are sending out fines to people who were properly parked though - fair enough no-one here has paid, but someone that doesn't know their rights might well do when sent an official looking letter.

  • Any ticket from Parking Eye is nothing but a speculative invoice and should be ignored.
    You will usually get 3 letters then 2 Letters from G White Solicitors with all sorts of threats. ignore them all
    Parking eye dont do court
    The DWP = Legally kicking the Disabled when they are down.

    Dont worry, I have no intentions of paying it, or contacting ParkingEye. Anyway been put in touch via Pepipoo with a local guy who's looking into it with the Hospitals Trust, as they are not happy with how they are operating. I've already successfully appealed 2 council PCN's in last 18 mths, so know that process, just this is my first PPC, so making sure of the facts. I've also sent DVLA an email asking what details they have given to a company that has no legal right, and that by doing so have broken the data protection act.

    our PCT no longer allows free parking for BB holders...surely the rest will follow?

    Most of England is going to do the same this year, its worth £150,000pa for an average size hospital, it's not yet clear to me that Scotland will follow suit but their track record in these matters say they will. Wales however will have some difficulty given their current BB issue policy.

    There are however even more complicated issues with the charging policy, in my area they already charge .. .. but .. .. 'the charges do not apply to disabled drivers on income support or pension credits' for example and NHS parking is free for all patients with cancer.

    BTW this is the recent Sunderland CHS cop~out for PrivateEye's sites - Sunderland Royal Hospital - Sunderland Eye Infirmary - Children's Centre (Durham Road) the details are :

    Registered Disabled Persons

    All blue badge holders must register their vehicle details with CHS Security to ensure free parking. This can be done by contacting the Sunderland Royal Security Office adjacent to Main Reception at the Kayll Road Entrance. You can also use one of the dedicated telephone facilities which are situated at all main entrances to the hospital. You can register immediately after parking your vehicle.
