A year after car crash, still waiting....

    Who was this cheque from? (If a third party, then they are the ones admitting liability, but if from your own insurer, then it's irrelevant to the liability issue).

    This from a letter dated 18th july " Please find enclosed a cheque in the sum of £250.00 which is an interim payment receieved from the insurers of the other driver."

    This looks like the liable party has been identified, and although it could take years for your compensation to be agreed you do need to ask your solicitor to get more interim payments.
  • yes your solicitor should know what insurer the interim payment came from, this would be the one established as liable.

    no GOOD solcitor on earth would ask for the case to be brought forward for settlement whilst your under treatment.

    have your solicitors requested you have a medical examination? this would give them an idea of how your injuries affect you, how long your expected to take to recover.

    sounds as if you were seriously injured, your employer could send you to occupational health, there your employer will get a better understanding of your injuries, and adjust your working surroundings to keep you in your existing role, or move you to a different role with training.

    My personal feeling is that this has slipped into a medico legal case, rather than a simple car crash and these can take years to come to a conclusion.

    Having worked for a medical expert in my past life we dealt with Irwin Mitchell on a regular basis and they were excellent, however some cases did 'drag' on for a number of years, from my point of view it was usually due to the complainant not responding to requests for information and not attending medical examinations.

    The fact that your treatment is ongoing is not really relevant to the delay, have IM requested that you see a medical expert to establish the cause of your condition and the likely duration of your treatment and pain?

    From my admittedly limited experience this is usually done to establish the award of costs.

    As an example, I suffer from back pain, having had an operation on my spine some time ago, but it is liveable with for the time being, if I should be in an accident that causes this pain to worsen then a medical expert would need to determine several things:-

    Has my quality of life suffered earlier than it should?
    Costs that I have incurred over and above what I would have done had I not been had an accident
    The prognosis, how long treatment will continue

    As I said before Irwin Mitchell are, IMHO, one of the more reputable companies dealing with these sort of cases - I would contact them again, ask if there is anything you can do to help.

  • Yeah I had a medical in april which was a massive waste of time. I am now apparently being sent for another but that was 2 months ago I was told this. My partners case handler called her yesterday and said they are still yet to establish fault even though I have recieved the excess back. Ideally I dont want the hassle of going to another solicitor but I am 10k out of pocket, possibly a job and I dont feel like my solicitor are doing enough for me.
  • Have you rung then today, if so what was said?
  • Just managed to get through and I am being sent to a specialist in london for a proper medical this time, not the 5 minute rubbish I had in april. my case handler was busy but she is ringing me back at some point today.
  • Case handler, is that an actual solicitor?
    If not may be worth asking to speak to one.
