A year after car crash, still waiting....

Hi all,

to cut a long story short. in February of this year I had a car crash which was not my fault. I was at the front of a 4 car domino affect type collision.

I had legal cover on my insurance so irwin mitchell took over my case. Since then because of my injuries I have been off work ever since. From day 1 I have had to pay for all my expenses (physio etc) and loss of earnings which has now totaled £10,000. The latest from irwin mitchell is they are still waiting to find out blame.

Now, I am a patient person but to me taking 10 months to not even find blame and to make me pay out on everything seems an absolute joke.

Do you think it is now worth going to a no win no fee company and them taking my case over as irwin mitchell seem to be just sitting on their hands doing nothing for me.

    Wouldn't you sue the person who ran in to the back of you? Then their insurance reclaims the cost of the person who ran in to the back of them and so on.

    I've not (yet) had to find out how the whole insurance thing works, but that was my understanding.

    Not sure if I understood the thread.

    Can you not claim from your own insurer or directly from 3rd party's insurer?

    What the no win no fee solicitor doing here?
    Happiness is buying an item and then not checking its price after a month to discover it was reduced further.

    Hi, thanks for the replies.

    my legal company have yet to find out who "is responsible" for the accident. I always thought that if multiple cars involves, whoever hit my car would have to pay, no matter who caused the accident. So because they haven't established blame, I am covering all costs for treatment.

    No I am still having physio and not at work. It looks like I will now have to change my career as well because of the crash.

    That's one reason and a very good one as to why it hasn't been settled yet.

    I am not saying it should be settled, I am saying that its taken 10 months and they still say they havent managed to contact the other persons insurance. Plus the fact that I have had no help with treatment costs.
  • You need to get an application in for an interim payment.

    I have done, I was told 2 months ago they were trying to get me one then this week i got a letter saying they still havent managed to make contact with the other party. its weird as I have had a cheque for my car repairs but now it seems like nobody is admitting it.
  • Ring the solicitor Monday morning.
