thanks for the opinions.
Car B was my wife. Car A is someone we know from the area.
Yes car A did a bad positioning, but my wife is probably guilty of being a little impatient. Road was wide enough for two cars but it is still a single lane. She was stationary at the time of the crash and for sure car A is guilty of not doing the final check.
We called (us and car A) for some time out and will think about it and get back together tomorrow to discuss who is at fault...
arrgghh hate this situation. its just a combination of two drivers poor driving skills!
Just as well you quoted Car A and Car B, otherwise the people on this forum would have found your wife guilty.The forest would be very silent if no birds sang except for the birds that sang the best0 -

it is a difficult situation.....
Yes my wife accepts she was maybe a bit impatience, but at the end of the day the other person is guilty for not doing a final check before turning. Thats the bloody truth. If I parked my car at night, lights off, in the middle of the road (which is wrong), and someone crash into me - its still their fault - in other words...as a driver you are responsible for making sure the coast is clear whatever happens.
The whole thing, even if was so minor and noone was hurt - serves a reminder that
1. Never talk on the phone whilst driving - it messes up your attention
2. Do a final check BOTH ways especially when your in a bad position on a junction! Even if you are not, its wise to do a final check in case there is a cyclist on the side
and as my driving teacher taught me - assume every driver on the road is a fool! (I am a good driver - 10 years now never had a single accident! thank god!)0 -

I only disagreed with you in your thread on the evidence presented. You seem to think someone with a difference of opinion is "out to get you" or arguing for the sake of it, but that is not the case.0 -

            I can't pass judgement on fault, there are too many factors and i've seen similar situations unfold, it can be either drivers fault depending on lots of different things...... But I'll say this......
If that had been a 44 tonne truck, which do often take a wide approach to corners (and do sometimes fail to indicate their intentions), the missus probably wouldn't be here to tell the tale.

Your not undercutting someone if the car is in a position to turn right and you want to go left.
If the there was enough room for Car B to go down the left side of Car A on a single carriageway road then it's not an undercut.. it's poor placing of Car A by driver of Car A.
No indication of direction and talking on the phone by driver of CAR A, along with placing their car in the position of turning right at a junction and not checking their inside left when decideing to turn left clearly points the entire fault on Car A.0 -

but the problem is.... you'd be unable to prove any, unless you're strider with your in car camera.0
