    There's no evidence in the OP that Car B had any way of knowing which way Car A was planning to turn. .
    In which case car B should have waited until car A's intentions were clear.

    Car B. road may have been wide enough for 2 cars but it is still a single lane unless otherwise marked. Car B should have used caution as the intention was not clear (I am assuming this was a T junction)

    Hi all

    thanks for the opinions.

    Car B was my wife. Car A is someone we know from the area.

    Yes car A did a bad positioning, but my wife is probably guilty of being a little impatient. Road was wide enough for two cars but it is still a single lane. She was stationary at the time of the crash and for sure car A is guilty of not doing the final check.

    We called (us and car A) for some time out and will think about it and get back together tomorrow to discuss who is at fault...

    arrgghh hate this situation. its just a combination of two drivers poor driving skills!

    I'm pretty sure if your wife was stationary then Car A has to accept fault..?

    It's been said already, the moving car, car A think? turned into the other car, so at fault.

    Didn't see it? doesn't matter, at fault.

    No one is innocent or correct or inncorrect, but someone carries the can for being inobservant????????????????

    No driver has to accept fault, in fact you are advised not too. Leave it to the insurance companies to work out.

    Car A is clearly at fault.

    1) Being positioned badly so as allow car B to undertake
    2) Driving in to car B because they weren't paying enough attention and didn't realise car B was there (possibly due to the mobile, though my opinion would be the same whether they were on the mobile or not)

    Sorry that's what I meant - Car A's insurance company has to take the fault. I deliberately didn't mention the driver :wink:
