Have you sent the court proof you paid the agent? Either a copy of the bank transfer, or requested a copy of the cheque back from the bank to show the court. Get that done as a priority.0

The court are happy with the proof they have received and have cancelled it (so she said today). I have ordered a certificate of cancellation so I can prove to Equifax that it has been cancelled so they can remove it of my report.

I'm sorry you feel that way but I disagree. I have never had to deal with the courts before so when the agent said she would send the proof off to them, I believed her. I spoke to the courts directly and was told on a daily basis to phone the agents and chase them to get it sorted...which is what I did. If I was meant to deal with soley with the courts, why was I not told this by the courts??
Also, you were sued for money which you knew damn well you had paid. So you knew equally well that the agent was either incompetent or malicious. And a little bit of thought [or coming on here] would have told you that the agent would not drop the case or lift a finger to undo the damage to you because that would result in them losing their court fee.

Please, do not breathe a word of what has happened to anyone at all. As DVardy says you had a part in this terrible misfortune albeit out of inexperience or ignorance of the magnitude of what was happening.0

Unfortunately the day I received the letter I ended up on the phone to my mum bawling my eyes out because I didn't have a clue what to do, who to talk to etc. Unfortunately again, I am stupid enough to think that they would do as they said - thankfully I have learnt from that mistake!! I didn't realise they paid for the court case or that they would lose it if they had to admit they were wrong which would make them act like @rses.Mummy to Oliver - 28/10/09

Gawd no! I really don't want my photo in the paper! I just want people to realise what a bunch of idiots the agents are. They are the most 'popular' in our area, they have the most properties up for sale, have sold the most etc etc hence why we went with them. Yeah, they value your house at a decent price and then make you drop it at least once a month! We were only with them 12 weeks but reduced it twice because of them telling us 'we'd get more interest' etc.

They value your property "at a decent price" to get you to sign up with them. Then, alas, market-forces mean that you will have to price competitively to find a buyer. You fell for all of that spiel and then you paid them a nice, fat fee to be released from their clutches. Happens all the time, except most agents don't take their ex-clients to court for monies they have already been paid.
Don't go anywhere near the press. The agents made a grave error but it all could be passed off as an unfortunate and regrettable bookkeeping mistake. And you'd still look like fools for not taking qualified advice while you still had time.0
