Dear Registered Keeper, Merry Christmas, Love Parking Eye.

Hi MSE'ers

this is my first post under Parking tickets, please be gentle with me :D

i have received a parking charge notice this morning from Parking Eye for a car that i am a registered keeper off but i am not the driver of. The car it relates to was parked on land that they 'manage'.

It isn't a superstore car park and the driver did not realise that you had to pay to park there. The driver stated that no signs were seen at the time and there are no pay meters there. The driver went back tonight to check it out and seen that there are signs stating that you have to pay to park there but you have to go into the reception to pay (in very small writing)
the day of the charge was a sunday and the driver was doing to voluntary work for a club there at the time, they are not the owners of the land but use it sometimes (i have no idea if that makes any difference|!)

reading through the forum i get the general jist that we should ignore this but i also read the case where PE took Mr Smith to court (and although he theoretically won, he still had to pay a small amount £15 & £95 iirc?)

i didn't know whether it is worth us

a) offering to pay an amount of £20 (£7.50 of actual charge and the rest as a gesture)
b) contacting the company who own the land and employ PE to see if they can get them to withdraw the charge

or

c) ignore it completely and hope we are not one of the minute cases that they do try and take to court.

The current charge is £90 & £30 admin fee or £60 if paid by 15.12.11

any advice would be gratefully received :)

    look its as simple as this,,,,a legal ticket is called a PENALTY CHARGE NOTICE=issued by local council,,police or traffic warden(ceo),,you have to pay it,,yes,, you can appeal,,you may win,,you may lose. now what you have in fact recieved is a PARKING CHARGE NOTICE,,this has no legality to it, yes you can appeal,, but they dont do appeals, so you will LOSE(ha ha no you wont),all it is is an unenforceable invoice,, REQUESTING you pay them money,, it in fact equates to loo paper nothing else,, now these parking companys like to scaremonger/threaten/intimidate,,all you have to do is this,,NOTHING,,just completely ignore all threat o grams they send,,they will threaten, court,,they wont go there because ,,they know,,we know,,and now you know they will lose 100%,,its just like a nigerian scam telling you that you have won the lotto,,,so rest easy,, remember ITS NOT A FINE,,loo paper,,so where the sun dont shine springs to mind,,,chill out now,, come back here as often as you like especially when you get those dead scary (not) leters in red ink,, then bigger red ink through your door,, nothing will/can happen to you.

    You're the registered keeper and so the charges have nothing to do with you at all. You are not obliged to tell them anything, so it's up to you if you want to tell them you were not the driver.

    If you want to, I would email them to save yourself a stamp, but be prepared for a reply containing lots of irrelevant legal nonsense about 'balances of probabilities' and other such crap. Remember PPCs want to extract money out of anybody they can and do this by being threatening at every opportunity. So you'll either be threatened through the post if you ignore, or threatened over the email if you don't.

  • I make a habit of ignoring begging letters from this scum and they usually give up after three.
    Still waiting for Parking Eye to send the court summons! Make my day!

  • My partner recieved a PCN today but he was not the driver i was. Should he reply stating that ??

    Just to add, Parking Eye until just recently, had (we think) never taken anyone to County Court. They then take two cases to court! The first case is odd and we still (I think) have not gotten to the bottom of this one. Smithy's case, while technically a loss, we would all consider to be nothing of the sort and we also think Parking Eye and Pannone will think exactly the same... but never admit it! Massive own goal by them and I suspect they will not be rushing back to sit in front of a judge in a hurry!

    So, option C is the best option!
  • Hi i got home to a letter yesterday too from parking eye. "parking charge notice to owner"

    do i pay or ignore i am in the wrong altho i didnt know at the time. It was the crown wharf shoppign centre in walsall, it used to be free for an hour then pay after that i was there 32 minutes.

    Can someone please help
