Just for information if you require the truth behind PPC tickets and their "business model" this is the place to be.
Pepipoo is a superb site giving invaluable excellent advice to motorists BUT
you are not allowed the whole truth on Pepipoo.
I have had two posts deleted because I dared to describe a PPC ticket as a "con"
The ticket was issued for not properly displaying a blue badge in a private car park.
So apparently issuing a "ticket" which implies that the issuer is entitled to charge an innocent person a penalty for breaching the rules of a scheme that does not even apply to the land in question is not a "con".
Censorship alive and well in Pepipoo land ...sad that such a great site feels that telling the truth is something that should be punished :mad::hello:0 -

It's already there for you to see ..this ticket falls squarely into the definition of a "con" because it attempts to part a genuinely disabled person from their money because they did not correctly display a blue badge.
Why this is a con :-
1) The ticket is a penalty it does not reflect any damages or losses to the car park operator. A private company can not in law issue penalties.
Statutory penalties are a matter for the state and are heavily regulated .
2) The blue badge scheme does not apply to private land. The car park operator is obliged in law by the virtue of The Equality Act 2010 to make reasonable adjustments for disabled customers. This why they HAVE to have disabled spaces.
3) As the disabled space is a requirement of law not an optional extra ANY person who is disabled as defined by the Equality Act is entitled to use said space -the only exception I can think of would be if the land owner had obtained an injunction against that person from entering onto the land at all.
NB There is no legal requirement for a blue badge as many people who are disabled as defined in the Act do not posess or indeed qualify for blue badges..I know this to be true as both my children fall into that catergory.
So in summary as I have already said : a ticket which implies that the issuer has the authority to issue a penalty for not displaying a blue badge when there is no legal requirement to do so is a CON.
Furthermore even if the parking company tried to argue that it was a term of the contract that the driver agreed to they would find themselves in dire straits at court as a contract can not possibly contain a term that overturns statute law.
At the risk of repitition I will say it again : ANY disabled person as defined in the Equality Act 2010 has an unconditional right to use a disabled space regardless of any blue,pink,yellow or other "badge" !!
One day a disabled person will take legal action against the land owner / parking companies allowing this CON and I expect said land owners and parking companies to be hung out to dry by a decent judge as what they are doing is at best unlawful and at worst criminal.0 -
