htc wildfire s software issue

i took out a new 2yr contract 4 months ago with t-mobile for which i received a free htc wildfire s. a couple of weeks ago the internet stopped working. i wnet into the t-mobile shop and they said not our problem we sold you a contract for the sim the phone was free, i rang htc and they said i can reset software to factory settings but unless i back up all my data i will lose it. some cannot be put on to memory cars so where do i stand legally ?
Are t-mobile lying to me do they have a responsibility as i took out a 2yr contract or is it a htc issue ?

If you got the phone from TM then it's TM's responsibility as they were the retailer. The fact it was free with the contract is irrelevent, they are still the seller.
If you bought the phone seperate from the TM service then you need to take it up with the seller of the phone.
Legally you need to be offered a repair or a replacment, and as HTC have offered a startiong place of a factory reset you need to follow that route, however you'll never find anyone who will accept responsibility for your data, it's your responsibility to back it up no one elses.
Bear in mind what you are having problems backing up, if it's an application then you should be able to re-download and install it from where you gor it from, you only need to conentrate on data you have created, images, contacts etc not programs you cna re-install.0
