    Whats the problem your having?
How long have you had the item and what is the item?
Do you have any indpendant reports of your own?
    What retailer is it?

Since your hearing is soon (and the retailer has allowed it to get this far) then what is the case based on? How much are you claiming and for what? What was the cost of the item in proportion to what your claiming?

    get your own independent report?

if a judge is faced with your word against theirs and they have a report you might be screwed unless you have an obvious fault.

disputes over comfort can be complex and unless you have the furniture i nthe courtroom you might be onto a loser.

My case is substantial and I have 'real' qualifications to back my argument.

    Do you care to share?

What advise are you looking for then?

Any advice regarding court protocols, how far does the judge direct the process and how best to prepare arguments. What to call the judge to.

It would be helpful if you answered arcon5's questions. We can't help with half a story.

I found FIRA to be very helpful, and no bias was shown towards the retailer. Without more information, we really cannot comment on what has happened in your situation.

    Advice required re:
court protocols, how does the hearing work, how to address the judge, how to prepare arguments. They have a barrister and I'm in person.

Why are you unwilling to answer the questions?

In the absence of expert evidence, then based on the (limited) information given, I would say you are screwed.

the small claims process is meant to be very friendly and geared towards making things simple - so you dont need to worry TOO much about formalities as the Judge is there to sort all that out - just make sure you know you are legally. i would advise making a chronological list of events and making clear how the law affects the process.

some peplel are surprised at decisions country court judges come to and people have said before that the judge sometimes puts too much of their opinion on it even though the law says something else.

i have sat in on some cases and basically the judge sat at the head of the table with the other 2 parties on each side. they will have all the paperwork in front of them and will ask questions etc. it is fairly straightforward - and the judges i saw gave very long and detailed summing ups of the judgement.

just go there on the day, dress smart, keep cool and make sure you know your story and position inside out.
