    He has been on a 12 months sick note and attended a medical firstly about 18 months ago and passed. As he had worked abroad did not have enough stamps for income related benefit. He received about 175.00 every 2 weeks. He failed ATOS as he was asked nothing about his medical history. Since appeal submitted he has been admitted to Hospital as an emergency 6 times.

    You are mixing things up, he wasnt entitled to contributions based ESA as he hadnt paid enough NI contributions due to working abroad, therefore he must be claiming income based ESA.

    ESA/ATOS has no intrest in medical histories, they are not relevant unless they are very, very recent so that has nothing to do with him failing the WCA, more likely he didnt supply supporting evidence to back up his claim in his most recent medical whixh is why he failed.

    And any hospitalisations since that wont affect his benefit disallowance, they are not relevant as the appeal can only look at what his health was like when he failed his latest WCA.
  • His health is the same as it was when he went for the ASOS questions
    which were basically could he walk talk and dress and feed himself. He has not had a medical since the first one He filled in the appeal form stating all his medical problems and frequent Emergency admissions.
    That was 10 weeks ago.
  • Should he inform DWP of the Emegency Admissions since the appeal although he is not well enough to keep ringing.

    If his condition has worsened, then yes, it may be worth asking the DWP for a new ESA50, and detail the new condition.
    This may be back-dateable, if you can supply medical evidence of the time the condition worsened.

    I'm unsure if you can backdate a change - I know you can backdate a new claim.

    This has to trigger a new evaluation of his condition, if it has worsened from the original submission.
  • I've just had a look at the crtieria you posted, but unfortunately I will not get anything!!

    It seems you have to be receiving a means tested benefit which is no good for us that go out and work instead of sitting down on the laptop all day and watching the soaps. Staying at home is certainly looking more attractive than working 16 hours a week for less than £100, and that's before I deduct the costs I incur in going to and being in, work.

    Yes, being not able to work is wonderful.
    I especially like getting so tired by an hour trip to the shopping centre that I'm picked up by the police as I'm suspected to be intoxicated.

    That has nothing to do with what I said.

    I was referring to the fact that as things are going, it isn't going to be worth my while going to work, as I would get just as much income for not working and claiming a means tested benefit.

    Plus I would then qualify for the Cold Weather payments.

    It just doesn't make any sense to me.

    Many people using this forum face the bleak prospect of long term inability to work. I am sure they would prefer yo be fit and healthy!!!!

    I note that if you're in work 8 hours a day, you don't need nearly as much heating.
