Cold Weather payments

Would a person who is waiting for ESA appeal and is receiving 67.50 per week as their only income be entitled to Cold Weather payments?

    However, once you are on 'main phase' - having passed, and been placed in either the WRA or support groups, then you get the backdated cold-weather payment, and christmas bonus.

    Wrong, for cold weather payments you need to be on income based ESA and that goes on household income and not just the person claiming ESA's income wether thats is their only income or not.

    Wrong only in the case they're on contributory ESA.
    If they're on income-based it's right.
    I read 'only income' to be 'only household income' - in which case they can be on IR-ESA.

    You are assuming, the information given is diffrent from the information you have "read" therefore you are wrong as you discounted one group of ESA claimant without asking which group the OP was in.

    There is a sticky at the top of this board the first page of that gives all the benefits that entitle you to cwps

    The person lives alone and received them last year but is waiting outcome of appeal.

    In that case - if the ESA they are receiving is income related - and if this is their only income and they live alone, this is very likely, then they will receive the cold weather payments when they win the appeal, unless they are eligible through some other route.

    For example - if they are also receiving DLA at the higher rates, entitling them to disability premiums on their ESA claim, (which the amount quoted would seem to suggest not, but the DWP don't always get this right), or they are in reciept of the pensioner premium.
