Legal advice about selling a car.

Hello,

I posted this in the wrong place at first...


I sold our old car for £1400.

He has now claimed a light came on and has cost him £900 to repair!

He is demanding £200 towards to cost of the repair.

For all I know he's mucked it up himself, or something?

He bought the car "sold as seen".

He says he is going to take me to court as this is all within 28 days of purchase.

Can he do this?

I did get one reply on the other thread:

Yes he can take you to court for anything he wants, even leaving your gate open.
Will he win the case, no.
He bought the car second hand in a private sale and it came with all faults and imperfections.
I would, Ignore him, until he puts up or shuts up.

    That reply is generally correct assuming you are a private seller.

    As to whether he would win that would depend on if he could prove you made any claims about the car which were untrue.

    The general rule when buying a car from a private seller is caveat emptor (Let the buyer beware) with the emphasise on the buyer to check the condition etc..

    I, just as politely, said I'm not prepared to give him any money.

    He's claiming the car has had the fault for a long time and I must have known about it.

    He then said something about "28 days" and "I know English law" (he's Polish, I think).

    He signed the receipt that has a paragraph saying "I confirm that I have purchased the above vehicle, sold as seen, having examined and road-tested it to my entire satisfaction".

    Actually, wouldn't a court rule in the OP's favour as the buyer signed a document with a written statement saying that any faults found after purchase aren't for the OP to pay for/fix?

    Which makes it even less likely that a court will ever rule in his favour.

    He found the fault, got the repair carried out and has only informed you of this after getting the work done.
    Even if by remote chance a judge did decide that you had some liability, you should have been given the chance to inspect the car before any repair was carried out.
  • Just have to hope I don't get a brick through the window now...
