Penalty Charge Notice advice please

    I've spoken to BPA today and they informed me that the company isn't registered with them and so won't be able to get my partners (who was the one driving) address from the DVLA should they wish to persue it further. They also told me that there isn't anything illegal about calling the ticket a Penalty Charge Notice so unfortunately I can't report them for that.

    You listened to the PPCs club and believed everything they said?!

    The company CAN get the registered keeper's details, by a paper application or by using a middle-man like Ranger Services. And no company can get the driver's details (how on earth could they?).

    And calling a charge a penalty is misleading - could be unlawful and pursued by Tarading Standards as an unlawful commercial practice. As I already said to you, the Police will not be interested but that doesn't mean Tradiung Standards and the OfT won't.

    And a fine or penalty is NOT enforceable in Court under contract law - but the BPA won't tell you that bit. The PPC won't take you to Court anyway but if they send letters threatening it then do not be concerned.

    Either ignore the whole thing or have fun with them and do something like the tongue-in-cheek reply I suggested above.
