Car Insurance No Claims Lost Even Though Blame Never Proved

Some advice needed please, 12 months ago my son in law was visiting a local supermarket, as he was driving away fom his parking space a car that was in another parking space reversed out into him as he passed, the damage was miniscual but the driver that reversed into my son in law insisted on claiming on his insurance even though it was his fault. The consiquence is that my son in law has lost all his no claims bonus. After leaving the car off the road for several months he changed his insurer to CIS and agreed their monthly premiums charge, he has now just received a letter increasing the premium by £50 per month just because the other driver will not admit that he reversed into my Son In Laws car.
Are they allowed to do this even though it was in a private car park and blame has never been proved. Is there anyone we can ask for help please?

Sounds like you should have pushed your corner a bit more, Where was the damage?
Side impact only then you should be able to prove the car was reversed into. If it was front
corner damage then it maybe 50/50.

Hi, did he not manage to get any witness/witnesses to this accident?
If he has not been able to prove blame against the other driver then it will just be reported as an 'own fault' accident.
He should only have lost a maximum of two years NCB.0 -

The damage to my Son In Laws car was above the nearside wheel arch, a tiny dent mark , the other car was a slight mark on his rear bumper, My daughter was a witness, but although she has given a statement my S. I. L. insurance has ignored this and have never sorted it out for him, just put the cost of his insurane up which is why he changed insurance companies. The other car owner claimed not my son in law by the way as the damage was so slight.

If your daughter is the driver's wife, then they may not accept she is independent!
His problem is waiting so long before kicking up a fuss!
His new insurer's stance is correct - he knew about the claim against him being successful (when his NCD was taken away from him), yet seemingly failed to disclose the claim when applying for the new policy, they checked up and found there had been this claim against him and now want the correct premium off him.0 -

Sorry but he DID tell the new insurer but they changed their mind about the premium amount he pays each month after about 2 months of being with them.
He has been complaining to his old company for almost 12 months and was told they were investigating the claim. it has never been settled!!!0 -

In that case he has an argument with his current insurer!
If he told them about the claim on his application for a quote, then (assuming this was included in his particulars in the policy paperwork they gave him), he needs to send in a written complaint about them wanting an increase 2 months down the line.0 -

Do you know where to complain to as I do not believe either Insurer has behaved fairly, or are these companies allowed to do as they wish?

They will both have published complaints procedures. Follow that and if you're not happy after you can go to the FOS.Do you know where to complain to as I do not believe either Insurer has behaved fairly, or are these companies allowed to do as they wish?

He'll need to raise a complaint directly with each insurance company, if they fail to resolve it you can then approach the FOS - you'll need to go through the insurer's own complaints procedure before you can approach the FOS.
Re the car park - It's a common myth that insurance will not apply in this situation. I have to deal with MANY disputed claims concerning drivers reversing from parking spaces. You'll be surprised how often these type of claims settle on a split liability basis - The at fault driver denies it's their fault. What are the third party alleging your son in law did?0 -

Thank you for your advice, re the car park, The third party are alleging that my son in law drove into them, my son in law was in fact driving along the road to leave the car park when the third party reversed out into the side of my son in laws car, My son in law did send photos into his then insurer as evidence but they have never settled the claim as the other driver who is the one claiming, not my son in law, is saying it is my son in laws fault.0
