    Legal Fraud definition - Conduct that is considered fraud under the law despite the absence of an intent to deceive because it has the same consequences as an actual fraud.

    Also:

    So taking money for something you do not have...........................?

    I'm no lawyer but would be surprised if that was 100% legit.

    A quick Google confirms that these definitions come from Merriam-Webster's Dictionary of Law ©1996. That would be US law then.

    For the UK read http://www.cps.gov.uk/legal/d_to_g/fraud_act/ - generally speaking, dishonesty is required.

    The notion of a branded company selling an OOS item being fraud is beyond ridiculous to be honest.

    I am sorry to learn of the problems that you experienced when making a purchase from the Comet site on Ebay.

    Unfortunately when the page was originally introduced, there was a system error, which meant products were put online that we were still awaiting the stock of. This error occurred due to a mix up between ourselves and Ebay and as soon as we became aware of this problem, we contacted all effected customers to advise of the error and offer either a refund or an alternative delivery date.

    I can confirm that this error has now been resolved and all products showing at the time of this post are available to purchase. Again, please accept my apologies for any inconvenience that this has caused.

    Could you comment on how / why you have removed customers feedback? Surely it should be a level playing field for all regardless of size. If a customer of mine leaves negative feedback eBay are VERY unlikely to remove it.

    Which is exactly what I did on Monday, our washing machine expired and looking round the internet saw a Zanussi at an atractive price on the Comet website. I tried to do a reserve for collection but saw that estimated delivery availability was 20/12 in all the local branches.

    Rather than wait I drove to the local independant supplier in the nearby town and had a wander round the showroom, after talking to a salesman I decided on a Hoover washing machine. Basically the Zanussi was made in China and the Hoover in the UK both the same price, similar spec, both in stock. So I bought British.

    I paid at 9:30 and it was delivered at 10:20 (for £10 including disposal of the old one). :j
