DRO nightmare
Good evening, I posted a while back (DRO help needed - joint loan & credit report) & here is my update as I have now heard back fromEquifax as I have explained everything to them & told them what was going on.....here is what I sent Equifax
“I have had a DRO issued & it was spent on 28th Sept 2011, since then Welcome finance are adding to my report every month that I am missing payments on a loan that doesn’t exist in my name anymore, I have contacted them & was told that "because the loan was taken out in joint names, the information will stay on my file" my credit score is never going to improve because of this, can you advise if this is correct please?
Please find attached copies of my DRO paperwork”

Debt Relief Order
With reference to the accounts included within your Debt Relief Order.
Please be advised that Debt Relief Orders are considered to be completely separate entries from the accounts they refer to, therefore Equifax are unable to amend or remove the account information.
The account information relating to your Debt Relief Order can only be amended or removed by the lender(s) concerned. After being discharged from your Debt Relief Order you can send proof of your discharge to all the lenders included on your Statement of Affairs, asking them to mark the account(s) as satisfied and the end date of the account(s) to reflect the date of the Debt Relief Order.
The lenders whose debts were included in your Debt Relief Order should then mark the entry on your Credit Report to show that you no longer owe money on that account. However, please be advised that lenders are under no obligation to amend or remove any information as a result of you being discharged from a Debt Relief Order.
The account information will remain on your credit report for a period of six years from the date that the account was settled, written off or defaulted, whichever occurred first. Should you wish to discuss the accounts further please contact the lenders directly.
Please can someone tell me that Welcome finance really can’t do this, I have spoken to the lovely people from CCCS & from the DRO Insolvency company & they have both told me that they can’t do anything but they have also said that it does not seem right that Welcome can do this. Equifax have said that “The account information will remain on your credit report for a period of six years from the date that the account was settled, written off or defaulted, whichever occurred first” this will never happen though as Welcome finance are saying its not settled so this will continue until I die... I really don’t know what to do any more. I don’t have a debt with Welcome anymore, my EX wife does, but seeming she won’t pay it then it will stop on my credit report for the rest of my life.......the only thing Welcome have said to me is “well you could start paying it as that could clear it”..............sorry rant over but if there is a credited financial advisor out there could you please send me a message.

It will remain on your credit file for 6 years, but your liability should now be removed as equifax et al say. It should be marked satisfied so definitely put in a formal complaint and then take it further.Total 'Failed Business' Debt £29,043

Yes it is all stupid, at the end of the day I don’t or won’t ever have a good credit score but I also don’t have any debt anymore so I guess this is a good thing. So what if I can’t get a proper bank account or I will never get a loan, not like I want another one so that’s sorted.
I have a good job, I have my health & I can sleep at night without worrying about money anymore. I will keep fighting this as I feel seeming I have had a DRO then my "slate" should be clean, but if im told NO this is how it has to be then so be it.......Welcome Finance can kiss my a**
Just one more thing before I go guys, I have been told that I can claim against Welcome as they mis-sold me PPI, when I first heard this I thought no as I have had a DRO & it just seemed wrong to claim against them but now im thinking screw them, just wanted your thoughts on this & what do you think I should do.0 -

Actually, no, it won't.
If your wife is not paying this, then Welcome should either have already defaulted the account, or if they haven't done so already then they really should do so soon.
Once defaulted, it will only stay on credit files 6 years from that default.
So it's not (or at least shouldn't be) "for ever".
If they try to string things out indefinitely by deliberately not registering a default, then that would be another avenue of complaint even if the DRO issue didn't go your way.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Who did you do your DRO through? Maybe they can help you raise complaints via the ICO, FOS etc?

I had a fair few problems 'cleaning up' my files after DRO. I found emailing the CEOs to be fruitful after wasting my time with 'customer services'.
ceoemail(dot)com lists most CEO emails for big companies, Welcome Finance is on there (martinth@cattles.co.uk), not sure what the score is with the company now though as they're effectively bust (http://www.bbc.co.uk/news/business-12624895)...
Worth a try though, worked for all 3 companies I was having trouble with.If it wasn't for the mistakes I made in the past (and learned from), I wouldn't be who and where I am today. It doesn't matter if you've cocked up, what matters is that you put it right and apologise. x0 -
Hi all, I have tried the company which I had my DRO though, they have said it doesn’t seem right what Welcome are doing but they are not financial advisors so they can’t advise me on the issue. I have spoken to the CAB & they have said they don’t feel welcome can do this & they have advised me to send a complaint letter to Welcome which I have done so watch this space......
