help with upgrading

I have not upgraded for quite a while, almost 4 yrs and was looking to upgrade around Christmas as my previous phone is now coming to an end. I use my phone for work and leisure.
I was looking to get the Apple I4s black doing my shopping to see what the best deals are. My service provider is with 02 but my billing is made by a middle company not to name them. Since i have not upgraded for that long i went directly to 02 in store to see what deals they would offer me since i have been with them for quite a number of years.
I wanted to see what they would offer me for the I4s as an existing customer, i presently pay £35 with 700 mins and 500 texts. They were offering me more minutes and more texts and including data for less than what am paying now. The problem i have is although am with 02 am not on their system. My details does not come up i was told because my billing is printed by this middle company i would have to tell them to migrate my details on to the system.
I called this middle company up and they gave me to alternatives I can either cut off my line or upgrade with them. The assistant on the phone was telling me that for them to migrated my details onto the 02 database i would have to upgrade with them first and my details will then show up. That all customers bills are now billed by 02 and this has been for a 1.5 years that this has been happening, but then this company has not sent me any details stating this at anytime.
I understand if i still have a contract with them (middle company) but i do not as i have not upgrade for a while. i do not feel like upgrading with this middle company i just want to leave them as they cannot get the simplest things right. Calling back a customer takes them three weeks.
I have had suggestions from friends to get my packcode; get a new line turn my old number to pay as you go. Means more work telling people about my new number. Report the company to Trading Standards i was also told to do.

    You are unlikely to get any deals on a I4S they are selling well without discounting, and there are persistant rumours Apple will not allow discounting.

    On a £35 PCM contract on a usual 24 months you'll be looking at paying £100 for the handset

    You are not restricted to O2 though, you could just move networks and port your number.

    One thing to consider if if you have a business contract you may have more features (like next day replacment in the event of damage/loss) you will not get on a consumer level tarrif. Business tarrifs are more expensive as they often have more backup in the event of issues.

    Not following you there. If your not on O2's system as you bought through someone elsey is that an issue for trading standards?

    If you are talking about CPWS O2, I'm afraid the advisor was there was correct however we have a few crossed wires I can clear up for you. For the last 1.5 years, CPW have been migrating their customers across to O2 directly when they upgrade rather than retaining. It is a very similar process to switching networks because both companies have two entirely billing systems. If you upgrade through CPW, they will switch you over to O2 directs billing systems. So in order to change to O2 direct you either have to upgrade through CPW and they will migrate you automatically or you have to take a new contract with O2 directly and then ask for your PAC from CPW to transfer your number.

    Now that last solution more than likely will not work because O2 do not offer the 4S to new customers at present. Sadly, there is no magical fix for this. There is simply no other way to move you across the billing systems.

    Also, O2 know this very well so I am unsure as to why they've got you all riled up and sent you on a wild goose chase.
