Speeding

Hi reading on other posts i know i am going to get a bit of jip for this but i am just looking for some advice please i know i have done wrong i think i know what the outcome is going to be.......

Basiclly tonight i was caught doing 90mph in a 60mph zone i am still within my first 2 years of passing my test.... Am i aswell to say goodbye to my licence??

Any info would be great

Once again i know i was wrong and my own fault completley.. Also need the car for work so prb going to lose job but can only blame myself

    I would in a case like this find the money required and get a damned good solicitor who specialises in motoring to go over the evidence.
    You would be amazed what can drop out when subjected to a fine combing.

    That's a bit rubbish.
    If you got a ticket then it should only be 3 points and £60 fine, in which case you should pay up and drive like a saint for the remainder of your probation.

    If it's a court summons (speeding only? Any careless/dangerous elements? What did the police say at the time?) then get prepared, get legal advice and be prepared to put forwards strong mitigation as to why you should keep your licence. You might get away with less than 6 points and a big fine, and so keep your licence.

    That's quite a big ask for 90 in a sixty though..... I'd be expecting 6 points and so a re-test.
  • Hi thanks for the quick replies yeah the copper said that he couldnt deal with it at the roadside and that i would be hearing from the PF in a few weeks. I'm just going to plead guilty no point in fighting it....

    But will they take into account that i need it for my job or will i get the 6 points and fine and lose licence do you think??

    I would say your only chance to save your licence is to fight and go not guilty, get full disclosure of the evidence and hope a mistake emerges, they may even not offer any evidence, it does happen.
    If you plead guilty, your licence is gone, if you plead not guilty and are found guilty, your licence is gone.
    However a damned good solicitor can argue after a guilty judgement that six points would automatically see you loose your job and ask for 3 points and a larger fine.
    Magistrates do not like putting people out of work if they can find another punishment.

    However, there is a chance, you could be found not guilty or the case is withdrawn as the police have messed up the evidence, do remember, it is one of the few jobs you can get with no qualifications whatsoever, they do make frequent mistakes.
    All I will say is if the police get wind you are going guilty, expect a few more eggs to get thrown in the cake about how you were driving ect.
    Thats the legal side, the moral brigade will be along shortly to enact medieval punishments upon you for your sins to society.

  • so vax am i better to get a lawer and speak to them and plead not guilty?? is that what your saying? i cant afford a lawer tho as i only work part time thru illness

    I wouldn't say that's 100%.
    Plead guilty and get a lenient judge who is receptive to mitigation and they could let you off without an effective ban, particularly if your job is on the line.
    Plead not guilty, !!!!!! about in the court with a few spurious and badly put together arguments and annoy the judge and then watch your licence evaporate.....

    However, I agree OP should seek professional legal advice as there's too much at stake to go on the word of the internet. Force some disclosure and see if everything is evidentially and procedurally sound, of it if looks like the whole thing is a !!!! up by the police. If the latter, then by all means see if you can get found not guilty.

    If the Police aren't doing their job properly, then they shouldn't be getting convictions on flawed evidence or bad procedure....
  • Thanks for all your advice guys it was total stupid of me i know. I cant afford legal advice tho as i said in previous post so i am just going to have to go it alone i think.....

    Post over on pepipoo.com and see what response you get. Give them as much of the fact as you can and see what they come up with. You won't get the the ear bashing, and they'll be more au fait with scottish law and any potential get outs for you....

    You may also qualify for legal aid (I don't know the rules in scotchland for that) which means you could get representation free of charge. See if there's a citizens advice bureau nearby who can help, or phone a local solicitor who deals in traffic law. They will know if they can claim for legal aid and represent you for nowt - they still get paid, jsut not by you.
