Yes I think it's wise to ask for it. They don't pay it automatically, but that doesn't mean they wont pay up if you press them to. They should, in my opinion, be prepared to offer a gesture in light of the fact that they have stolen your money for five years. They must know that they have taken your money and yet they were never prepared to go through their records and return your money to you.0

Many thanks to Martin and the newsletter for nudging me to check up on this topic. Luckily, my mortgage had been with the Halifax who have a telephone number to call. A bit of research to find my old roll number, less than five minutes on the phone, et voila, a cheque for £100 on the way.

sorry reply is late however when i went to northern rock i took a 20 year mortgage with a special rate for two years they wrote to us and said they were no longer continuing but had made special arrangments with lloyds tsb or we would have to pay penial rates as my ltv was only 50% i moved to nation wide however i still feel it was a case of financial blackmail0

My old mortgage was closed with Abbey National in 2000 - I contacted them and was told they wouldn't hold information that far back. Is that right?
(a) they aren't required to keep information that old; and
(b) they won't owe you anything anyway. How many times does it have to be posted that the main increases in MEAFs happened in the 2000s, not in the 1990s?0 -

Thanks to Martin and the forum, I read this thread in February. I used the template letter and wrote to Northern Rock for a mortgage I switched in October 04. I had no idea whether I had paid the Discharge of Morgage fee or not but worth a second class stamp!
I have received confirmation that I paid the fee and have accepted an offer of £250. They state that the fee applicable at that time was £225 yet I paid £250. They state it is not their policy to add interest.
Heck, I should have known I had paid, but didn't and the £250 will be gratefully received, having been recently made redundant.

This is my first post, but one that I am eager to make. After reading Martins article about reclaiming mortgage release fees I downloaded his template and began the process of reclaiming against the Bank of Ireland. Straight away I recieved a letter saying that I didnt have a case. A standard response to put me off.
I therefore downloaded a Subject Access Request template off the web, and went back with a further complaint and this time requested that they provided me with all the information they had on file about me, as per the Data Protection Act (Information Commissioner Office)
Guess, what before I have recieved my information I got sent a letter stating that they were willing to refund me the whole fee. That is £195.00 for the sake of £10.00 (Subject Access Fee)
So really I just want to say that dont be put off by any standard responses to your initial contact. Keep going, use Martins information, the information provided by the Information Commissioners Office and Im sure you will have the same success as me.

Read the article, called the numbers provided for Halifax and Alliance and Leicester (my only two mortgages). Halifax had charged me what they said they were going to (remortgaged after FSA ruling), but A&L has just sent me a cheque for £100 - the difference between what they charged me and what the terms and conditions said they were going to! Result - just one easy phone call! Thanks to this site!:beer:0

Just received £100 back from Halifax. They said that the charges were correct on my account at the time but were prepared to pay £100 goodwill payment! I'm not arguing!0
