ESA medical-any truth in this?

The first time I had a medical for my depression and anxiety I felt it was very rushed, only 20 minutes and I was being interrupted when trying to give as much information as possible. I failed and when I received the paperwork back I could see that there were questions that I hadn't been asked.

I appealed and the appeal centre forwarded me the response given to them, not sure if it was from Atos or the DWP, they claimed that they don't ask all the questions directly that they will phrase things differently or ask in a round about way. They hadn't asked me anything in any way, shape or form relevant to a couple of the questions on the form. I explained this and continued with the appeal which was successful.

When I had my medical, she kept going on at me, until she got an answer for the computer.
She asked if I could make a cup of tea.
I said I don't make tea or hot drinks for myself.
She said "but you can though?"
I told her on bad days, I don't do anything. My eldest makes me something to eat at tea time and I get a drink from the bathroom
She said, "but you can make a cup of tea?"
Erm, yes, I can actually make on, if I had to

So she put down, no problem making tea, following a set of complex instructions and you have no problems with memory or learning.

once again a thread that proves that ATOS isnt fit for purpose even though the "atos rep"got involved,proves you cant defend the indefensible

Why was my medical not carried out by the HCP you claimed would carry it out. Why did the HCP in my medical admit that they had not read my completed ESA50 form they had in front of them. Why are there grossly incorrect 'facts' in my medical report that have no apparent source. Why does my medical report contain a prognosis that the HCPs involved in my care say is laughable or baseless. Will you answer any of these questions or should I just jump off a bridge and save your company some aggravation. In fact you've angered me so much that this month I will be filing an official complaint to ATOS HC and the DWP regarding the events of my medical. Time is up.

To the Op... in my medical 3 well established techniques were used in questionning. Good cop/bad cop was evident depending upon which seemed most successful in getting 'suitable' responses from me. So do not be surprised if the HCP has dramatic shifts in apparent approach or personality during the assessment. There was use at times of rapid firing of questions - this seemed to be a tactic to prevent me explaining fully my problems in relation to question asked (or to prevent exhibition of some symptoms of mental illness like rumination)...i.e. my answers were interrupted probably due to not conforming to standard responses suited to the HCP on the LiMA software. Medicals will however vary quite dramatically - that is one thing we can say for sure... experiences vary widely... and unfortunately so do the reports in relation to the claimant's reality.

when i was on IB, and then claimed DLA, i had a medical by a HCP for IB, then 3 months later a home visit by the same HCP, i had a whitness with me at my home plus i was very ill at the time with chest problems not long after recovering from pnewmonia wich almost took my life.

i'll detail the inaccuracies, IB report stated by this HCP, customer breathless at rest, not in cardic respiritory arrest, lips purple, finger nails purple, wich suggests lack of oxygen supply, it is evident that customer is in an episode of severe asthma attack.

customer refuses to engage in eye contact.

customer barely able speak due to breathlessness at this time.

customer cannot walk more than 10meters due to breathlesness, customer condition worsens upon excertion of walking, becoming wheezy and everso tight chested.

customers mental health is a factor towards his main condition, panick attacks, to wich in my medical opinion has braught on todays asthma attack anxiety is evdident as customer is shaking, and bouncing his leg.

examination cut short it is evident that customer is in excempt catagory, a return to work is not expected in the forseable future.

heres the DLA report.
customer suffers with severe brittle asthma, pannick attacks anxiety and other mental health issues.

customer seems anxious, and uncorftable at rest.
wheezing is evident, and short of breath customer is using nebulizer with 5.0ml ventolin solution.
(list of other meds to take daily)

on physical examination customer can walk unaided 200meters on level ground without breathlesness or pain or discomfort.
customer can ascend and descend stairs with no aids, no help form others. customer has no physical limitations to limbs all limbs are present. customer walks with a slight limp walking gait is consistant of that with a healthy young man.

customer can dress and undress and look after his personal appearance without help.

customer has no nightly issues.

customer drives in and around local area wich suggests that customer has no lack of concerntation or mental impairment to such that his every day life would be affected by his mental health conditions.

now for one no physical examination took place i did not move off the settee as i was too weak and unable to. so how he drew to a conclusion that A i could walk 200 meters is questionable.
he knew i walked with limp due to the fact of the 3 months prior IB assessment!.
had he completed a physical assessment he would have discovered that i do infact have trouble ascending and descending stairs, by the time ive got 3-5 steps im huffing and puffing and trying to suck on my ventoling inhaler, the problems i have with my back sometimes i cant even get up the stairs to start with and need support to do so and he was informed of this.

HCP was told i only drive local as anxiety prevents me from driving long distance, i get panicky when i drive to a place that is unknown to me, the use of the car is mainly for hospital and doctors and taking children back and forth school, and even then my father takes me to the hospital apppointments because the spirometry test takes the wind out my sails and makes feel very ill after it, he was told that i have a set routine, that i do not deviate from set routine and if i had to break set routine i become uncofortable, irratable, angry and physically violent, he asked if i had been in Arrested by the police in the last 12months as a result of my mental illness, i hadnt been arrested was reply because i hadnt, as i hadnt gone out!.

none of this was implemented in his report.

after the report was completed, he said that i obviously have asthma i obviously need a level of perosnal care and support and that i should recieve a level DLA and to take of myself and that all will be well and fine.

when i had the report i noticed the name to the IB report and the name on the DLA report were slightly different, as in he had switched his initials around to differ from the IB report but same surname name!, by doing this i am ademant that he was going to make and fabricate the DLA report to go against me in any case.

the IB report and DLA report was used in the tribunal bundle, the tribunal judge had infact pointed out that the surnames on both reports were the same but initials were swtiched around and asked me "is this HCP the same perosn who carried out the IB assessment?" i repliied yes it was he carried it out three months prior to the DLA home assessment, the judge said, "its unfortunate that Atos and DWP do not have to attend a tribunal, i would have liked to ask this question to them and find out why exactly did this HCP decide to change is first and second initials"
"did this HCP recognise you when he attended your home" i replied yes as when he saw me he double took in his body language as if to say i know you, he also hinted at the IB assessment i had by saying how have you been since the last time i say you when he came into the house.

the judge and panel laughed and the judge said i "can only conclude that this report be inadmissable as evidence for the DWP, im of the conclusion this report does not reflect the opinion of the HCP involved in the assessment, it is a stark contrast to the report made by the same peron just weeks prior for the IB assessment in wich he himself places you in an exempt catagory, your own evidence provided to the DWP and us today suggests you are entitled to a level of DLA, but we need to establish wich levels those are"

at that point in the tribunal i was so overwhelmed and anxiety kicked in that i had to leave the room, my mum and my reprasentative carried on the tribunal for me.

so to say that Atos carryout every examination with the pretext of the claimants condition and professionalism is a false claim at at that.

you can also dismiss the roumers about having set targets, it was let slip on that despacthes investigation, it would not be said if it were not true, it is also funny that (some has posted here) that they had a Atos assessment for work purposes that retired those from work but yet upon their ESA claim assessment you find 0 points and tell those very people that you retired that they are fit to work!
