Unwanted emails - unsubscribe but still getting them

What are your rights regarding unsubscribing and requesting to stop emails/ spam, and despite promises they will, you still get spam / promotions?
I purchased something online some time ago from Tesco and made sure to opt out of any email options. However I was getting regular promotional emails from them. I clicked on the unsubscribe link. However I still carried on receiving them. I knows theres worse thing happen in life, but this was just really annoying especially as I had requested it to stop. I emailed customer services. I got the reply "Just to let you know that I have unsubscribed you from our mailing list so you will receive no further correspondence from us"
However, Tesco still emailed me spam / promotions. I emailed again asking them what I need to do to stop this. Nothing. Emailed again saying its not acceptable, get a response "This is unacceptable and I will make every effort to see that you are unsubscribed from our list."
They still kept coming.... I then threatened legal action. (for what I dont know actually know but thought it might get them off my back)
They still send me Tesco ads/spam. They asked me to forward the ads to which I did. Got no response, so reminded them Im still getting spam - they sent "we can do all we can to help stop the emails. We certainly don't want to cause anymore upset " so they still send the spam and just taking the !!!!. I have since found out that if you unsubscribe it is actually breaking the law to keep harassing me with this unwanted emails.
What can I do to put a stop to this?

    Are they actually from Tesco or are they dressed up to look like Tesco emails, because appearanaces can be deceptive.
    With regards to unsubscribe links, the best advice is never to click on a unsubscribe link in an email if you're in doubt as to the sender. Go to the website yourself and use the unsubscribe there.

    According to the ICO:
    Electronic mail marketing messages should not be sent to individuals without their permission unless all these following criteria are met:

    The marketer has obtained your details through a sale or negotiations for a sale.
    The messages are about similar products or services offered by the sender.
    You were given an opportunity to refuse the marketing when your details were collected and, if you did not refuse, you were given a simple way to opt out in every future communication.

    Download a copy of Mailwasher, the free version, set it up with your e-mail information, use Mailwasher 1st before your e-mail program, then you can bounce them back, usually their systems will remove you after a couple of bounces. (Not guaranteed)

  • Thanks people for your help. Yes they are definately from Tesco, it just annoys me when I have repeated requested for them to stop and actually get promised by the company themselves that they will stop. Will write complaint to this Ico , thanks for that.

    Why don't you just add that address to your spam filter or otherwise block the address?
    No free lunch, and no free laptop ;)
  • Please don't use the bounce facility in Mailwasher. The from address in spam is usually spoofed and all you are doing is sending a faked non-delivery mail to an innocent person. It will NEVER reach whoever sent it and even if it did do you really think he will do anything about it. Bounce may have been useful around 10 years ago but it is useless with today's spam - sadly Firetrust still tout it as a 'feature' of their software. Other than that, Mailwasher is a good tool for deleting spam.

    If you're getting junk from a sender you've never dealt with, clicking unsubscribe simply confirms that your email address is valid and they'll continue sending them. Mostly they just send out emails en masse using largely randomly generated email addresses in the hope that some of them hit real accounts. You have confirmed yours is real.
