MBNA - Is it Legal!!??

Okay so I finally received as of today a "copy of executed agreement" from MBNA.
On the part where it says "Signature of Customer" remains unsigned.
However a box has been tick claiming it has been authorised i.e. electronically.
Credit agreement is still however, unsigned by me manually.
I was told by the Office of Fair Trading that it still has to be signed manually by the customer.
Account opened in 2009.
Is this legal please??

My daughters ppi failed on this,she said she did not put a signature on it,nor either ticked box for ppi,they refused to pay her on both these counts
Not right as far as we are concerned ,so sent on to the Ombudsman.0 -

References in the Act to the term “signature” include electronic signatures.
Section 7 of the Electronic Communications Act 2000 refers to electronic signatures
and describes how a signature given electronically may be admitted in evidence and
may be taken as a valid means of establishing authenticity of documents.
Articles 4, 5 and 6 of the Order amend current Regulations including the Consumer
Credit (Agreements) Regulations 1983 so that where the content of signature boxes and
notices are prescribed, the creditor or owner may also include information about the
process or means of providing, communicating or verifying the signature to be made by
the debtor or hirer. These changes are specifically for enabling the creditor or owner to
explain to the debtor or hirer how the document may be signed by an electronic
communication.
So yes it is legal so cough up what you owe.0 -
