Phone paypal and ask them when the case will be finalised- I assume you have fully escalated this to a full chargeback.

yes i escalated it to the highest claim.

surely paypal can just track where it was withdrawn too (bank account) and take it out??

It was the first time i had been on gumtree and saw quite a few add's saying 'Paypal' Only so i assumed that was the best way to go about paying for the item as i wouldnt have just sent a cheque, as i thought paypal was 'safe'

Gumtree is supposed to be a face to face venue- people can use paypal but it does rather rely on users knowing what they are doing.

Also a single click through from the gumtree home page to 'staying safe' brings this up:

    http://gumtree.force.com/Help/articles/General_Information/Buying-safely?retURL=%2Fapex%2FknowledgeSafe&popup=false

    which makes it obvious

It doesn't matter, as long as the item was eligible and you sent it for named goods (ie the ipad is stated on the invoice) then you are fine. They do not have to recover the money to refund you, they will persue the seller to recover their own losses later.

Exactly - Gumtree isn't designed for distance selling BUT PayPal is designed for sites like Gumtree. They'll see you straight

I'd always give paypal a ring if the time frame for refund appears to have slipped

That is actually incorrect. If the buyer has paypal buyer protection it doesn't matter whether the seller has withdrawn the money or not.

It changed about 4 years ago so the protection si the same both on and off ebay.

    Thanks for that Soolin.

My post was from personal experience but it is quite some time ago (Possibly 6 years). My wife made a claim to Paypal and was refused on the grounds that Paypal could not recover the money as the sellers account had been closed.

I think it saved a lot of problems with on ebay v off ebay sales, we used to argue endlessly about it on here until the system was tidied up.
