GUMTREE Item Paid for Via Paypal and NEVER recieved

Hi,

About 3 weeks ago i bought an item through Gumtree but paid via Paypal (so i have some protection).

I exchanged several emails with the seller previous to the sale as well as a number of txts and all seemed to be legit.

once i had paid for the item i emailed the seller and text him to say that i had paid and was looking forward to recieving the item.

A week passed and i still hadnt recieved and sort of tracking number or a response to my email. So i tried ringing him several times but the phone just went straight to voicemail, so i started to get a bit worried.

I then opend a dispute through paypal and it is in the 'waitng for selle's response' phase of proceedings but i can almost guarentee that the seller will not get in touch as the phone still goes straight to voicemail and the emails i have sent dont get a reply.

so my question is.. WILL I GET MY £300 BACK??

I like to think i can sniff out a scam pretty well but the seller seemed very genuine and is clearly very good at this.

Any info or similiar situations that have been resolved would be greatly appreciated.

Regards
Anthony

Was what you bought covered by Paypals buyer protection scheme?

At PayPal, we are continuously striving to ensure that payments made within our community are safe, by providing specific terms and conditions that need to be followed by buyers and sellers. We help to cover you in the event that something goes wrong with your purchase of tangible, physical goods which can be posted.

PayPal's Buyer Protection provides a method for buyers to issue formal complaints regarding goods paid for through PayPal but never received, and regarding goods purchased and paid for through PayPal that the buyer receives but that are significantly not as described by the seller.

However, there are some payments that we do not cover including payments for services, real estate, businesses, vehicles , custom made items, airline flight tickets, eBay classified advertisements, licenses and most intangible items. In addition, items prohibited in the PayPal Acceptable Use Policy are ineligible for coverage.

PayPal’s Buyer Protection aims to provide an additional layer of security, however this does not affect your consumer rights and we advise that you contact the Citizens Advice Bureau or Trading Standards for further information.

As long as you paid for goods & didn't send a gift payment, it was sent in one payment then you should get your money back, as you have the same protection off ebay as on it.
So long as it's something that will be covered by paypal protection.
  • hi, thanks for your replys,

I assume i am covered as it was an Ipad 2 that i was buying (well have bought :@)

it was paid via a credit card if that makes any differance?

Obviously too late now, but i wouldn't be buying an ipad off gumtree unless i was collecting in person and paying cash.
Gumtree has a huge amount of scammers and 99% of them use ipads and iphones as bait

Not having a go or anything but you spent £300 without first checking that you had adequate protection?! Luckily you have but with buying anything online spend 10 minutes checking out any websites and method s you are paying by. It could save you a lot of money.

Shopping online can be perfectly safe if you know your rights and dko a bit of research.

The item itself is covered by Paypal's policy so you should be ok. You need to open a case now though and get in quick.

When these are scams what tends to happen is they sell lot's of these desirable products quickly, withdraw the money back to the bank and close the paypal account. In these instances is not unknown for paypal not to refund as they cannot get the money back from the seller.

Don't want to alarm you but the quicker you act the better the chance of getting your money back

i opened a dispute 6 days after when i realised something was wrong.

however if its that easy to just accept a paypal payment withdraw it to your account and close your paypal account how can paypal say its 'safe' thats too easy to do anyone could do it

That is actually incorrect. If the buyer has paypal buyer protection it doesn't matter whether the seller has withdrawn the money or not.

It changed about 4 years ago so the protection si the same both on and off ebay.

However I agree that it would be wise to get a full chargeback in immediately- don't waste any more time on this.

Phone paypal and ask them when the case will be finalised- I assume you have fully escalated this to a full chargeback.

It was the first time i had been on gumtree and saw quite a few add's saying 'Paypal' Only so i assumed that was the best way to go about paying for the item as i wouldnt have just sent a cheque, as i thought paypal was 'safe'
