Ticket in an allocated underground spot

Hi all,
This is the first time I've posed on this forum. Hope someone could help.
I've received a £90 parking permit from a private company. I am renting a flat with an allocated parking spot underground. The particular parking space is rather right backed against a wall. 98% of the time I would reverse my car so the boot is facing the wall. Ultimately how I park the car is my choice as long as it is in its spot. This particular occasion, I parked it with the front facing the wall, and thus the back of the car was what anyone approaching would clearly face.
Apparanty, according to a sign on the underground car park, which I hadn't read to be honest, states that 'Parking permits must be clearly displayed in the front windscreen so that complete permit can be seen at all times'.
However, because it would be clearly displayed and visible at all times - I put my pemit on this occasion at the back of my car (clearly visible). It made no sense to put it at the front as you would have to walk all the way around my car to see it. Hence why I put it at the back to help anyone who may approach and need prove that it was parked legally.
I have received a £90 fine for this, which raises to £145 if not paid within a specific period.
I genuinely cannot believe it.

As it is your allocated parking spot you are under no obligation to pay this "fine". The company making the demand have no legal authority to fine you, so all they have done is issued an invoice, which is unenforceable. If the parking spot is mentioned within your rental agreement as yours then you don't owe them a penny.

Thanks for your post. Much appreciated. I merely presumed because they have a sign displayed that ... that will be the argument they pursue? Ultimately, I was given a parking permit as part of my tenancy agreement. I do accept it is my responsibility to make sure this is displayed in my car to prove it is my car that should be in the allocated spot etc, but I find it ridiculous that it has to be displayed at the front. This makes sense if you are parked in the middle spots of the car park where front and back are both open. But in a closed space, where the front is facing a wall, it makes zero sense.
I tried to explain this to them on the phone. Why would I deliberately put it at the back to be awkward or incur a fine?!0 -
Does it say anything in your tenancy agreement about having to display a permit? If it doesn't then you have no problems at all. Even if it did the parking company cannot fine you and they can only claim for any losses incurred. As it was your parking spot they have lost nothing, and they can't go the trespass route as it was your parking spot."You should know not to believe everything in media & polls by now !"

Does any of the detail matter - for goodness' sake this is not a fine.
Read the sticky threads, look at the letter-chains of threats you may well receive (and you will of course totally ignore) and watch the Watchdog clip which is on the sticky thread 'welcome, please read before posting'.
This is just a fake PCN, no a real one and you have given them far too much of your time already. Spend a bit of time reading the permanent sticky threads on the top of the forum instead:
