Can you sue the police for failing to act?

            Quite a few times they arrived with blues and twos going ( I used to be her neighbour at the house she shared with her ex)
 I also find it very strange that out of 26 call outs she has not been taken seriously at all even though he was arrested on at least 8 occasions at the property but released without charge either due to lack of evidence or conflicting statements before the Non-molestation order was made, after that he just refused to admit he was there and had witnesses to say so.Little Person Number 4 Due March 2012

            It still has nothing to do with it, just because someone works in a hospital, does not mean they are able to perform brain surgery, people have been arrested for much less, none of us here need to be a barrister to know that there is a large part of the story missing, he just threw her through a window for no reason?
 Why don't she go to the media?
 I had a GF once that the most amazing things would happen to her, but all the time it was when there was nobody else in the party to verify her stories.

 I dont think this guy is untouchable, I just think she had an unfortunate pair of bumbling dimwits that believed hook line and sinker that she threw herself through a glass window to try and frame him and taint his good nature.
 So, with evidence of injuries from her hospital admission she then sought legal advice? Insisted that the police review the case as she was in fear of her life? Removed herself to a place of safety?
 It wouldn;t be the first time a police force have failed victims of domestic violence etc etc and made a huge catalogue of errors regarding evidence and failing to do their job properly.
 Really? The snippets you read in the papers are an extremely small percentage of the throughput of successful cases where victims have been assisted, lives saved and convictions made.
 The police can only act on the facts as presented to them - with respect, you do not appear to have witnessed these acts and these conversations so it is hard to know what went on, isn't it?
 If you want clear advice then, as your friend is doing tomorrow, she needs to seek independent legal advice.
 To sue, she will need to show that the police failed to do their job and that she suffered a loss as a result of that failure.

 Just becuase I don't take on the full story without question, does not make me an idiot, are you saying women never fabricate stories , fakely accuse guys of rape?
 Lets be honest here, this person you refer to this 'friend' is either not the full ticket or an attention seeker, perhaps then you could raise a case with the Police Complaints authority, besides that the refuge will have agents that are able to advise this friend of yours.

 You read it that way because you chose to read it that way, who is to say the friend is not sleeping with his brother or something, of course it does not make it ok, but there are some mitigating circumstances purposely omitted from the story, there is lots of help available to the victim in question, and within a month somebody from somewhere MUST feel she has a case to answer.0

 So they did act and investigate! The police cannot proceed without the support of the CPS - if there is insufficient evidence then it is not their fault. Without independent and credible witnesses it would be very difficult to take it further.
 Just because you were a neighbour does not mean that you knew what actually happened.
 If your friend was unhappy with the outcomes then she could have asked for a review. She could have sought legal advice.:hello:0

 The numbers for Women's Aid are in my signature, pass them on to your friend and advise her to call the relevant number. Her local WA group should have good working links with the local domestic violence unit within the police force.
 I'm not getting into the whole 'what did she do to deserve it' rubbish, that's the type of attitude has no place in a civilised society. Suffice to say that people experiencing domestic abuse tend to minimise and under report what is happening to them, not exaggerate it.

 I don't recall a post saying she deserved it, after 26 reports and nothing done about the situation does not seem the full story is being told, the station I'm sure would have given out literature to guide the OP's friend. But must confess the whole saga seems so ridiculous that to me it seems unbelievable.0
