TomTom One Offer - Doesn't Work. Who is Responsible?

I recently signed up for a contract with e2save where I get a 'free' TomTom One in exchange for an 18 month contract. Received TomTom One last Friday but it doesn't work. Who is technically responsible for either repairing it or sending me a new one? I thought it was the retailer (e2Save) but they've palmed me off by saying they have no way of repairing it and I have to contact TomTom One directly.
Can anyone help at all?

I think legally the Sale of Goods act says e2save have to provide an item which is fit for the purpose - free or not.
I could be wrong though.0 -
Your contract is with e2save and they are responsible for having the TomTom repaired or replaced. Sometimes the manufacturer will offer free reprairs. and can be quicker to go through them.
But you don't have to contact the manufacturer, you can insist e2save sort it out.0 -
I would contact tom tom direct on 0845 1610 009 and they should deal with it for you.0
