Tesco have had my phone since August for repair
In September 2010 I took a 12 month contract with Tesco, I paid £275 for a Samsung Galaxy S, . In July 2011 the phone developed a fault where it would reboot every few minutes so I rang Tesco and they asked for the phone to be sent to one of their repair centers which I did in July. I been chasing it up since August, At first they told me its been fixed and they will be sending it back to me, I waited for about a week and still not recieved it so I rang Tesco back they go its been sent out by Royal Mail and I will need to wait at least 15 days and if i still havent recieved it then ring back which I did, then when I rang them they said they will contact royal mail and since end of September I been getting told either its being investigated.
I still haven't cancelled my contract despite it ending in September 2011, as i'm using the sim in another cheap £20 Nokia phone.
But I am very annoyed at the moment, I been getting promised call backs from a manager and not heard anything back from them, everytime I ring I get told manager is in a meeting.
Could someone advice me on what I should do as I am fed up now.

If you have sufficient paperwork to prove that they have failed to repair the phone as per your post, then I would do a Letter Before Action (LBA), giving them 14 days to either
(a) return your repaired handset
(b) supply you with a replacement handset
In the letter, you should tell them that failure to so so will cause you to take them to the Small Claims Court for the full value of the handset plus court costs and reasonable compensation for the period that you have been without the phone.
Keep the letter short and to the point , send it recorded and then be prepared to follow through.0 -
Your contract was never 'ending in September 2011' it continues until you cancel.
In view of the service issues you need to provide them with a date to provide your replacement 21-28 days hence, and state that if you are not in receipt of the handset by that date, you require the contract to be cancelled with immediate effect, and you will pursue them for the full cost of a replacement handset. (Send a copy to CS too, so this will act in starting your 30 day notice period - in case it is needed).0
