Fulfilled by amazon

Hi,
I am thinking of buying electronic item from Amazon. The item is sold by the seller and the order is FULFILLED BY AMAZON. This means amazon do stocking, dispatch and invoice as well. I was concerned about the warranty of the item before purchase and called up Amazon to find out about my rights. But they fobbed me off saying that I do not get any warranty !!! Even after mentioning EU directive 2000 for Distance selling regulation which states 2 year warranty for any of the item bought online.

Can someone clarify where do I stand in this situation?

    Buy somewhere else if you dont like how they deal with the orders.

    You're probably thinking of the "secret EU law", which doesn't apply in the UK as SOGA and DSR confer greater rights to the consumer.

    Is the order to be fulfilled from Jersey or one of Amazon's UK warehouses?

    Can you point us to a link to the item in question?

    You will have the option to return for a refund for a short period under the Distance Selling Regs but other than any manufacturers guarantee I don't believe that a seller is obliged to offer a waranty.

    I believe you can have a case if an item fails after a time that is considered less than acceptable for that specific product (SOGA?)?

    Amazon are only acting as an order fulfillment house. They are not selling the product.

    Your rights under the DSR, Sale of Goods Act etc. will not be affected but the contract will be between you and the marketplace vendor, not between you and Amazon.

    Good idea to make sure the seller is a business. If they are a individual, your rights are extremely limited if something goes wrong.

    Good idea to make sure the seller is a business. If they are a individual, your rights are extremely limited if something goes wrong.
    The fact that they are sourcing enough stock to use Amazon as fulfilment surely means they are a business by definition anyway, even if they haven't registered as such with HMRC? I doubt many personal sellers would have a few hundred/thousand units of a particular item lying around that they just need to get rid of!

    Amazon FC's are mostly Amazon stock but they do carry some marketplace items. The majority of items are Amazon's own though (a large majority) and even then, a few hundred units at most.

    I didn't mean 'a few hundred thousand', I meant a 'few hundred' or a 'few thousand'. Surely its highly unlikely that a private seller would have even a few tens of a particular electronic item unless they have bought them to re-sell? You wouldn't use fulfilment if you only had one or two to sell!! If they have bought for resale then they are acting as a business and therefore are surely bound by the relevant regulations?

    I know of a few market place sellers that use Amazon fulfilment - I'm considering it myself at the moment for a few lines. The OPs post gave me the impression that it is a 3rd party seller using Amazon fulfilment.
