Which was pretty much what I was saying earlier up above. The driver would have to prove that the council either removed the PCN or that someone else did in order to be able to use the excuse that no PCN was on the windscreen.
Even if they can prove that, it doesn't mean they'll get off. We had one years ago where this had happened and the adjudicator ruled in our favour even though the driver had managed to prove that the PCN had been removed by a passer by (could of been the drivers friend / neighbour/ drinking pal etc for all we knew).0 -
No really, you are wrong, if you look nice and say please to the old fart who looks at your case on behalf of TPT, you may just win!.
Even so I would not even consider TPT until you have asked to pay reduced amount, why would you want to spend time dealing with TPT and the hearing when you can pay 25 quid!. That's probably not even an hours pay for you, Good Luck anyway and let us know how you get on!.0 -

They would not have to 'prove anything' on that subject, because it would not help to know who may have removed a PCN, if there's a photo showing it was indeed served. But they could use another grounds for appeal of course - that is what I meant.
People who post on pepipoo win in almost every case (around 90%+ IMHO).
Oh, and here's the figure for 2010 successful parking appeals, 57%:

Cannot agree that people should be urged to pay £25 rather than go to adjudication, when the odds are in their favour and there's a website like pepipoo which can help them to win.
But we know which side of the fence you sit on so it's not really surprising you are suggesting someone offers to pay.

Maybe I've just had it drummed into me too much but we used to hear about forums like pep at work and used to laugh at their so called success rates etc. Sure, a few do get off and there is genuinely some good advice there but on the majority of cases where the authority has issued a good PCN, good photos, good notes, good lines and signs and a valid TRO.. there isn't much to appeal on.
Last time I was on the pep forums I saw a lot of people looking for loopholes and frankly there wern't many people who seemed to have much of a chance.0 -

The trouble is with the pepipoo forum is that it encourages people to look for miracle loop holes.. and a lot of the time they just don't exist.

Thats always the easiest thing for people on the loosing side of a parking arguement to say to someone in the trade. The fact is most parking folks who are on these forums are here to try and offer insider help and information. When you non parking folk then hear something you don't like you try to turn it around on us and have a dig even though in reality it isn't directly our fault and if we didn't do the job someone else would).0 -

Complete poppycock !!!! Firstly how does a driver "prove" who it was removed by ?
I never received my ticket from the local council and went to appeal when I got the demand for the higher amount. The council kept trying to bully me into paying the higher amount until we were actually at the appeal hearing. They then and there offered me the chance to pay the lower amount. Thankfully I turned the chance down as I went on to win the appeal.All aboard the Gus Bus !0 -
So you're saying that the driver doesn't have to prove that the PCN was removed or not received ? They can just say it and the adjudicator will let them off right?
I think you're onto a winner there mate. Go and setup one of those websites promising the "Get off your PCN guide" for £10 a time. I'm sure you'll be rich by XMas.0
